Alaska Power of Attorney Notarization Requirements and Remote Options

One of the most common execution errors in Alaska estate planning is confusing the signing rules for financial powers of attorney with those for healthcare directives. They have completely different requirements — and using the wrong process invalidates your document.

Financial POA: Notarization Required, No Witnesses

Under AS 13.26.600, a financial power of attorney must be:

• Signed by the principal (or by another person directed to sign in the principal's conscious presence — that person cannot be the designated agent)
• Acknowledged before a notary public, Alaska court clerk, or U.S. postmaster

That's it. No witnesses required for a financial POA. This is simpler than most states, which require one or two witnesses in addition to notarization.

Healthcare Directive: Two Witnesses OR Notarization

The Advance Health Care Directive under AS 13.52.010 has a different standard:

• Signed and dated by the principal
• Either notarized or witnessed by two qualified individuals present during signing

The witness pool is restricted — a witness cannot be:

• The designated healthcare agent
• A physician or healthcare provider currently treating the principal
• An employee of the treating healthcare facility
• An employee of the principal's residential facility
• At least one witness must be unrelated by blood, marriage, or adoption and have no claim to the estate

Remote Online Notarization (RON) in Alaska

Alaska fully authorizes Remote Online Notarization under AS 44.50.075. This is critical for families in bush communities, North Slope workers, and military personnel deployed from JBER or Fort Wainwright.

How RON works:

1. Connect with an Alaska-commissioned RON notary via secure audio-video platform
2. Present government-issued photo ID through the video connection
3. The notary verifies identity through knowledge-based authentication questions
4. Sign the document electronically while the notary watches in real time
5. The notary applies their electronic seal and signature

Key rule: The notary must be physically located within Alaska during the session, but the principal can be anywhere in the world.

Standard RON fees: $25 for the first notarial seal, $10 for each additional seal.

The Rural Postmaster Exception

Alaska's geography creates a unique notarization option that exists in no other state. Under AS 44.50.180, AS 09.63.010, and federal regulation 39 CFR 222.2, U.S. postmasters in Alaska are authorized to act as notaries public.

For a postmaster notarization to be valid:

• The postmaster must sign the acknowledgment in their official capacity
• The title "Postmaster" must appear next to the signature
• The official circular cancellation stamp must be affixed to the document
• The document must state the post office name and exact date
• No surety bond is required

This costs nothing — postmaster notarization is free. For families in remote villages off the road system where the nearest commercial notary requires an expensive charter flight, the local postmaster is often the only viable option.

Common Notarization Mistakes

Mixing up financial and healthcare rules. Getting two witnesses for a financial POA doesn't hurt, but skipping notarization invalidates it. Conversely, a healthcare directive with only notarization (no witnesses) is perfectly valid.

Using an out-of-state notary for non-RON notarization. Traditional in-person notarization must be performed by someone commissioned in Alaska. RON is the exception — the notary must be Alaska-commissioned but the principal can be out-of-state.

Failing to record for real estate. If your agent will handle property transactions, the notarized POA must also be recorded with the District Recorder's Office (2-inch top margin required on first page, or face a $50 non-standard document penalty).
