Guardianship is a judicial proceeding where the probate court appoints someone to manage the affairs of a person who has already lost capacity. In Alabama, the court may appoint a guardian (for personal and healthcare decisions) or a conservator (for financial matters), or both.

  • The court chooses the guardian, considering family preferences but not bound by them
  • Requires a formal petition filed in the probate court of the incapacitated person's county

When You Still Need Guardianship

A power of attorney only works if the principal had capacity when they signed it. Guardianship becomes necessary when:

  • The person never executed a POA and has already lost capacity
  • An existing POA is invalid (improper execution, lost document, expired notary)
  • The named agent is unable or unwilling to serve, and no successor is named
  • The agent is misusing their authority and the court needs to intervene
  • The incapacitated person's needs go beyond financial management (personal care, living arrangements, healthcare decisions beyond what an advance directive covers)

How They Interact

Under the UPOAA, a court-appointed guardian or conservator can supersede an agent's authority. If a guardianship is opened after a POA is already in effect, the court can modify, restrict, or revoke the agent's powers.

However, if a valid POA is already in place and the agent is acting properly, the court may decide a guardianship is unnecessary. A well-executed POA is the strongest argument against an unwanted guardianship petition — it demonstrates that the principal planned ahead and named a trusted decision-maker while they had the capacity to do so.
