Indonesia Estate Lawyer Cost: Probate Attorney Fees in Jakarta and Bali
Estate settlement in Indonesia involves multiple professionals — notaries, land deed officials, court-appointed lawyers — each with separate fee structures. For foreign families, the total bill often comes as a shock because nobody explains upfront which services are mandatory, which are optional, and where the real money goes.
Mandatory Government Fees (Fixed)
Before considering professional help, here's what the Indonesian state charges regardless:
Death certificate registration at Dukcapil: Free under Law 24/2013. If anyone charges you for this, they're extracting an unofficial fee.
BHP Certificate of Inheritance (for Eastern Foreign classification): Rp 200,000 per certificate, Rp 20,000 per confrontation minutes, and Rp 20,000 per certified copy — set by Government Regulation No. 28 of 2019.
BPN land title verification: Maximum Rp 50,000 under Government Regulation No. 128 of 2015.
BPN registration for title transfer: Free if filed within 6 months of death (Article 61, PP No. 24/1997). After that window, the fee is calculated as (land value per square meter × land area) / 1,000.
BPHTB inheritance tax: 5% × (assessed value minus regional tax-free threshold). Many regions apply a 50% discount for inheritance transfers. Properties valued below the threshold owe zero.
Notary and PPAT Fees (Percentage-Based)
This is where costs scale with the estate's value:
Notarial inheritance deed (Akta Keterangan Hak Mewaris): Typically 0.5% to 1.0% of the total asset value. For a Rp 5 billion estate, that's Rp 25–50 million (roughly USD 1,500–3,000). This covers the Notary's wills registry search, drafting, and authentication.
PPAT property division deed (Akta Pembagian Hak Bersama): Similar 0.5%–1.0% range. Required when multiple heirs need individual land titles split from a shared certificate.
Notary fees are negotiable in practice, especially in less competitive regional markets. In Jakarta and Bali, where foreign clients are common, notaries tend to charge at the higher end.
Court Costs for Contested Estates
If the estate goes to litigation — either because heirs disagree or because you need a formal court determination for high-value bank accounts — costs multiply:
Court filing fees vary by jurisdiction and claimed estate value. They're modest compared to attorney fees.
Legal representation is where the real expense lives. Indonesian probate attorneys charge retainers that compound across multiple hearing sessions. A contested inheritance lawsuit (Gugatan Waris) can stretch across months of hearings in the Religious Court or District Court, with the possibility of appeals to the High Court and Supreme Court.

When You Don't Need a Lawyer
Many routine estate tasks can be handled by heirs directly:
- Dukcapil death certificate registration: Self-service at the civil registry
- Kelurahan-level SKW (for native Indonesian deceased): Drafted by heirs, witnessed, and certified by the local Lurah and Camat — no legal professional required
- Voluntary court petitions: Indonesian courts offer integrated service desks (PTSP) where heirs can file uncontested heirship petitions without legal representation
- Bank account claims under Rp 10 million: Usually processed with a Kelurahan-level SKW and standard documentation
When You Definitely Need One
Professional legal help becomes necessary for:
- Foreign will enforcement: Validating a foreign testament requires court proceedings that typically span up to 14 months
- Property under the 1-year rule: Foreign heirs racing the divestment deadline on Hak Milik land need a PPAT to execute the transfer quickly
- Contested inheritances: Any dispute among heirs requires formal litigation
- Minor heir estates: The BHP guardianship system involves oath administration, asset inventories, and annual audits that benefit from professional guidance
