Power of Attorney Witness Requirements Tasmania: Who Can and Can't Sign

One ineligible witness makes the entire EPOA invalid in Tasmania. The LTO will return it, and if the principal has already lost capacity by the time you discover the problem, you can't fix it — the document is dead and you're heading to TASCAT instead.

How Many Witnesses, and What They Must Do

A Tasmanian enduring power of attorney must be signed by the principal in the physical presence of two independent adult witnesses. Both witnesses must:

  • Be present in the room when the principal signs
  • Be present in the room with each other when they sign
  • Complete the statutory declaration certifying the principal signed voluntarily and appeared to understand the nature and effect of the document

The witnessing is simultaneous — the principal and both witnesses must sign in the required presence arrangement. The attorney's acceptance can be signed later, but must be completed before registration. You cannot have Witness A sign on Monday and Witness B sign on Tuesday.

Who Cannot Witness

The exclusions are strict and absolute. The following people cannot witness an EPOA in Tasmania:

  • Any named attorney or substitute attorney in the document
  • A close relative of the principal — spouse, de facto partner, parent, child, sibling, grandparent, grandchild
  • A close relative of any named attorney — same categories as above

These exclusions exist to protect the principal from undue influence. If either witness falls into an excluded category, the LTO will reject the registration application outright.

Who Can Witness

Any independent adult (18 or older) who is not excluded above can witness an EPOA. There is no requirement for either witness to hold a professional qualification.

That said, having at least one authorised witness strengthens the document against future challenges:

  • Justice of the Peace (JP)
  • Legal practitioner
  • Medical practitioner
  • Police officer
  • Pharmacist
  • Minister of religion

A JP is the most common choice for Tasmanian families. JPs witness documents free of charge and can be found through the Department of Justice Tasmania's JP directory or at many local council offices and Service Tasmania outlets.

The Regional Witness Problem

In small Tasmanian communities — particularly on the West Coast, King Island, Flinders Island, and rural north-west — finding two independent adults who aren't related to either the principal or the attorney is a genuine hurdle. In a town of 300 people, everyone is someone's cousin.

Practical options:

  • Local pharmacists or GPs are often eligible and willing to witness, and their professional status adds weight to the document
  • Service Tasmania outlets can direct you to local JPs, though the JP may not always be available on your preferred signing day
  • Police officers at the local station can witness if they meet the independence requirements
  • Visiting professionals — accountants, bank managers, or government workers who travel to regional towns on regular schedules

Plan your signing day around witness availability, not the other way around. Call ahead and confirm your chosen witnesses are available and willing.

What About Remote or Electronic Witnessing?

Tasmania does not permit remote video witnessing or electronic signatures for deeds. An EPOA is a deed under Tasmanian law, and it requires a physical wet signature witnessed in person.

Several Australian states introduced temporary or permanent remote witnessing provisions during COVID-19, but Tasmania did not extend these to enduring powers of attorney. Every signature must happen with everyone physically present in the same room.

Witnessing the Enduring Guardianship

If you're also setting up an enduring guardianship (the personal and medical decision-making document), the witnessing rules are similar but not identical:

  • Two adult witnesses, both independent of the appointor and the guardian
  • Witnesses cannot be related to either party
  • The guardian must also sign an acceptance section acknowledging they've read any existing advance care directive

The same two witnesses can witness both your EPOA and your enduring guardianship instrument in the same sitting, as long as they meet the independence requirements for both documents.
