For estates valued at KES 3 million or below, there's a faster and significantly cheaper option: the Office of the Public Trustee. What the Public Trustee Does

The Public Trustee is a government office established under the Public Trustee Act (Cap 168). It administers small estates through a process called Summary Administration. Instead of filing a court petition and waiting for a Grant of Probate or Letters of Administration, the Public Trustee issues a Certificate of Summary Administration — a document that carries the same legal authority as a court grant for the purpose of transferring assets.

Who Qualifies

The Public Trustee handles estates with a gross value of KES 3,000,000 or below. For even smaller estates valued at KES 100,000 and below, the Deputy County Commissioner (DCC) can issue authorization letters directly, which is the fastest route of all — typically resolved within 1-4 weeks.

There's no restriction on the type of assets. The Public Trustee can administer bank accounts, M-Pesa balances, land parcels, vehicles, and NSSF benefits, provided the total estate value falls within the threshold.

The eCitizen Process

The Public Trustee's services have been digitized and are accessible through the eCitizen platform (publictrustee.ecitizen.go.ke). Here's the process:

  1. File PT Form 1 (Report of Death) — this initiates the case. The form must be witnessed by a Magistrate or Commissioner for Oaths
  2. Submit supporting documents — death certificate, chief's beneficiary letter, national IDs of the deceased and all claimants, marriage certificates where applicable
  3. Pay the administrative deposit — KES 2,500, paid when opening the file
  4. Public Trustee investigation — the office verifies the assets and beneficiaries
  5. Certificate of Summary Administration — issued once verification is complete, giving you legal authority to transfer assets

Costs Compared to Court

The cost difference is dramatic:

Timeline

The Public Trustee route typically takes 3-6 months, compared to 6-12 months (or years for contested matters) through the formal court system. The process is faster because there's no mandatory 30-day Gazette notice, no six-month waiting period for asset distribution, and no formal court hearings.

When to Use the Court Instead

The Public Trustee cannot handle your estate if:

  • The gross value exceeds KES 3 million
  • There's a serious dispute among the beneficiaries that can't be resolved administratively
  • The estate includes complex corporate shareholdings or international assets

In these cases, the formal court process under the Law of Succession Act is required.

Trusts for Minors

The Public Trustee also manages trusts for minor beneficiaries. If a portion of the estate passes to a child under 18, the Public Trustee can hold the funds in trust until the child reaches majority, making periodic disbursements for education and maintenance in the meantime.
