Peru Bank Account After Death: How to Unfreeze Funds as a Foreign Heir
The moment a death is registered at RENIEC, Peruvian banks automatically freeze every sole-ownership account in the deceased's name. This happens within five to seven business days of registration — no notification to the family, no grace period, no exceptions.
For foreign families who may need those funds for immediate funeral costs or to pay the deceased's rent and utilities, this freeze creates an acute cash crisis.
Why Accounts Freeze Automatically
When RENIEC registers a death, the civil status update propagates through Peru's integrated database. Banks check this registry regularly. Once the DNI shows a "deceased" flag, all accounts under that number lock.
Joint accounts where both holders have full access rights may continue to function for the surviving co-holder, but sole-ownership accounts — including savings, checking, fixed-term deposits, and investment portfolios — freeze completely.
What You Need to Unfreeze Them
Banks won't release funds to anyone without proof of legal heirship. You need:
- **Completed *sucesión intestada*** — either the notarial Declaration of Heirs or a judicial ruling, registered at SUNARP
- Certified copies of the Death Act from RENIEC
- SUNARP registration certificate showing the succession declaration
- Identification for all declared heirs (DNI for Peruvian citizens, passport for foreigners)
Timeline: At minimum 30-45 days (notarial route) before you can access funds. If disputes exist and the judicial route is required, expect 12+ months.
The Credit Life Insurance Shortcut (Seguro de Desgravamen)
Before trying to unfreeze accounts to pay off the deceased's debts — stop. Peruvian law requires credit life insurance on most consumer loans, credit cards, and mortgages. This insurance legally cancels the outstanding balance upon death.
What to do:
- Submit the Medical Certificate of Death (complete, double-sided) to each bank holding the deceased's debts
- Include the certified RENIEC Death Act
- Provide copies of identification
The bank activates the credit life insurance, which zeroes the balance. The heirs inherit no liability on those debts. This applies to credit cards, personal loans, and most mortgages issued by regulated banks.

AFP Pension Funds
If the deceased had a private pension fund (AFP), the situation is different from bank accounts:
- Surviving spouse and children under 18 (or under 28 if studying) can claim survivor pension benefits
- If no qualifying dependents exist, the full AFP balance can be claimed by the declared heirs after the sucesión intestada is registered
- AFP claims require: Death Act, succession declaration, relationship proof, and the specific AFP's claim form
Each AFP (Integra, Prima, Profuturo, Habitat) has its own process and timeline — typically 30-60 days after complete documentation is submitted.
Life Insurance Claims
Separate from credit life insurance, Peru mandates employer-provided life insurance (Seguro Vida Ley) for all employees with four or more years of service.
Critical deadline: Beneficiaries must file within one year of death. After 12 months, the employer legally claims the insurance payout for themselves.
Contact the deceased's employer to identify the insurer and obtain claim forms.
Practical Workaround for Immediate Cash Needs
Since unfreezing accounts takes weeks or months, families handling immediate costs (funeral, accommodation, travel) typically:
- Use the family's own funds and seek reimbursement later
- Access joint accounts if any exist
- File for the EsSalud funeral subsidy (up to S/ 2,070) if the deceased was a regular employee or pensioner — deadline is 180 days
The Peru Expat Death Guide includes the bank-by-bank unfreezing process, AFP claim workflows, and a worksheet for tracking which accounts are frozen and which debts qualify for automatic cancellation.
