Power of Attorney NSW Regional Areas: Getting It Done Without a City Solicitor

If you live in Dubbo, Tamworth, Broken Hill, or anywhere outside the greater Sydney metropolitan area, setting up an enduring power of attorney should not be harder than it is for someone in Parramatta. But in practice, the prescribed witness requirement creates a genuine barrier in parts of regional NSW where solicitors are thin on the ground and the nearest Local Court might be an hour's drive away.

The good news is that there are more options than most people realise, and the process does not require you to travel to Sydney.

The Prescribed Witness Requirement

An enduring power of attorney under the Powers of Attorney Act 2003 must be signed in front of a prescribed witness. The eligible categories are:

  • An Australian legal practitioner (solicitor or barrister)
  • A Registrar of the Local Court of NSW
  • An approved employee of NSW Trustee & Guardian

A Justice of the Peace cannot witness an enduring power of attorney in NSW, which is the point where many regional families hit a wall. JPs are widely available in country towns — they operate at courthouses, community centres, and shopping centres. But they are only authorised to witness statutory declarations, affidavits, and certified copies, not enduring powers of attorney.

Finding a Prescribed Witness in Regional NSW

Local Court Registrar. Every Local Court in NSW has a Registrar who can witness an enduring power of attorney. There are Local Courts across regional NSW — Dubbo, Orange, Bathurst, Wagga Wagga, Tamworth, Lismore, Coffs Harbour, Armidale, Grafton, Broken Hill, and many smaller centres. The witnessing service is free, but you need to make an appointment. Contact the court directly and ask to schedule a witnessing appointment with the Registrar.

This is the most accessible option for many regional families. The court does not charge for witnessing, and the Registrar is experienced with the prescribed form.

The Law Society of NSW Solicitor Referral. The Law Society of NSW maintains a solicitor directory searchable by location and practice area. If your nearest town has a solicitor's office, they can witness your EPOA even if they did not draft it. Most solicitors charge $50–$150 for witnessing alone. Call (02) 9926 0300 or search the online directory for practitioners in your region.

NSW Trustee & Guardian. NSWTG offers witnessing services and can arrange appointments at regional locations. For full Age Pension recipients, NSWTG provides free document drafting and witnessing. They maintain offices in Sydney, Parramatta, and Newcastle, and arrange periodic visits to regional centres. Call 1300 109 290 to ask about availability in your area.

Audio-Visual Link Witnessing

Since amendments to the Electronic Transactions Act 2000 (NSW), enduring powers of attorney can be witnessed remotely via audio-visual link — a video call on Zoom, Skype, Microsoft Teams, or similar platforms.

The process works like this:

  1. You prepare and print the EPOA form
  2. You connect with the prescribed witness via a live, continuous video call
  3. You position the camera so the witness can see your face and your hand signing the document
  4. You sign the document with a wet-ink pen while the witness watches
  5. You scan or photograph the signed pages and transmit them to the witness electronically
  6. The witness reviews the document, signs their own counterpart, and adds a mandatory statutory endorsement confirming the document was witnessed over audio-visual link under Section 14G of the Electronic Transactions Act

This is a genuine option for people in remote areas, but it requires some coordination. You need a reliable internet connection strong enough for a stable video call, a printer, a scanner or phone camera, and a prescribed witness who is willing to conduct the process remotely. Not every solicitor will agree to remote witnessing, but many regional and metropolitan practitioners now offer it.

LRS Registration From Regional NSW

If your attorney will need to deal with real property (buying, selling, mortgaging, or leasing land), the EPOA must be registered with NSW Land Registry Services. Registration costs $182.71 and requires submitting the original EPOA plus a completed Deeds Index Particulars form.

LRS accepts postal lodgement. You do not need to attend their Sydney or Parramatta offices in person. Mail the original documents to LRS by registered post, and they will process the registration and return your documents. Standard processing takes five to ten business days.

Electronic lodgement through the LRS online portal is also available, though it is typically used by conveyancers and solicitors with registered PEXA accounts. If you are using a local conveyancer for a property transaction, they can handle the electronic lodgement as part of their service.

What to Do in an Emergency

If a parent in a regional hospital has suddenly lost capacity and there is no enduring power of attorney in place, the two immediate options are:

Ask the hospital social worker about the person responsible hierarchy. For routine medical consent, the hospital can accept consent from a spouse, carer, or close relative under Section 33A of the Guardianship Act. This does not require an NCAT order or any court involvement.

Apply to NCAT for a financial management or guardianship order. NCAT can hold emergency hearings within 24 to 48 hours for urgent situations. The application is free. Contact the Guardianship Division on 1300 006 228 (option 2) and explain the urgency. NCAT can conduct hearings by telephone or video link, so physical attendance at a tribunal location is not always necessary.

The best time to sort out an enduring power of attorney is before anyone is in hospital. For regional families, that means booking a witnessing appointment at the Local Court, arranging a call with a regional solicitor, or scheduling a video link session.
