How to Refuse an Inheritance in Czech Republic
Czech law ties the acceptance of an inheritance to the assumption of the deceased's debts. Heirs are jointly and severally liable for all estate liabilities. If the deceased left more debt than assets, accepting the inheritance means you personally owe the difference.
You have two statutory options to protect yourself — and strict deadlines for both.
Option 1: Full Refusal (Odmítnutí dědictví)
You can completely refuse the inheritance by making an express declaration to the court-appointed notary (soudní komisař). This is an all-or-nothing decision:
- Unconditional: You cannot refuse part of the inheritance and accept the rest
- Irrevocable: Once declared, you cannot change your mind
- Deadline: You must submit the refusal within one month of being notified of your right to inherit. If you reside outside the Czech Republic, the deadline extends to three months
The refusal must be an explicit, formal declaration — silence or inaction does not count as refusal. If you miss the deadline, you are treated as having accepted the inheritance.
Option 2: Inventory Reservation (Výhrada soupisu)
If you want to accept the inheritance but protect yourself from unlimited debt liability, invoke an inventory reservation. This limits your personal liability for the deceased's debts to the actual net value of the assets you inherit — you never pay more out of pocket than what you received.
The inventory reservation must be declared to the notary before the inheritance resolution becomes final. The notary then conducts a formal inventory (soupis pozůstalosti) of all assets and liabilities.
When this matters most: An estate with a mix of valuable assets (real property, bank accounts) and uncertain liabilities (business debts, tax obligations, unknown creditor claims). The inventory reservation lets you inherit the assets while capping your exposure at their value.
How Debts Work Without Protection
If you accept the inheritance without invoking either protection:
- You inherit all assets and all debts
- You are liable beyond what you inherited — creditors can pursue your personal assets
- If there are multiple heirs, liability is joint and several — any single heir can be held responsible for the full amount of estate debts
This is why the inventory reservation exists. It is the most commonly used protection for heirs who want to inherit but face uncertainty about the estate's net position.

Practical Considerations for Foreign Heirs
Language barrier: The refusal or inventory reservation must be formally declared to the Czech notary. If you do not speak Czech, bring a certified interpreter or submit a certified translation of your written declaration.
Remote heirs: If you live outside the Czech Republic, the extended three-month refusal deadline applies. You can make the declaration through a Czech attorney acting on your behalf — but the Power of Attorney granting them this right must be specifically drafted and authenticated.
Multiple estates: If the deceased held assets in multiple countries, refusing the Czech inheritance does not automatically affect proceedings in other jurisdictions. Each country's succession law operates independently (though EU Regulation 650/2012 may apply to determine the governing law).
What to Do Right Now
- Ask the notary about the estate's net position at your first meeting — get a preliminary picture of assets versus debts before deciding
- If in doubt, invoke the inventory reservation — it protects you while preserving your inheritance rights
- Never miss the refusal deadline — once it passes, your only option is the inventory reservation
- Consult an English-speaking Czech attorney if the estate involves business debts, disputed claims, or cross-border assets
