This requirement blocks more foreign inheritances than any other single step. Here's exactly how it works and what to do.
What a Fiscal Representative Does
A fiscal representative (representante fiscal) is a Portuguese tax-resident individual or entity who acts as your postal and legal contact with the Autoridade Tributária (tax authority). They receive all official tax correspondence on your behalf, and they're legally responsible for ensuring you meet Portuguese tax obligations.
Every non-EU/EEA resident who needs to interact with the Portuguese tax system — including receiving an inheritance — must appoint one. This includes citizens of the US, UK (post-Brexit), Canada, Australia, Brazil, and any other non-EU country.
Why You Can't Skip This Step
Without a NIF, you cannot:
- Be named in the Habilitação de Herdeiros (heir qualification deed)
- Receive transferred property, bank funds, or vehicle titles
- Be listed on the Modelo 1 stamp duty declaration
And without a fiscal representative, a non-EU resident cannot obtain a NIF. The entire estate settlement chain stops until every heir has one.
Three Ways to Appoint a Fiscal Representative
1. A Portuguese Lawyer or Solicitor
The most common route for inheritance cases. Your estate lawyer can serve as your fiscal representative or arrange one through their firm. Typical cost: a one-time setup fee of €100-€300, plus annual maintenance fees of €50-€150 while the NIF remains active.
2. A Specialised NIF Service Provider
Online services exist specifically for non-residents needing a Portuguese NIF. They appoint a fiscal representative, handle the application at the Finanças office, and post you the NIF certificate. Costs range from €150-€300 for the complete package. Processing takes 5-15 business days.
3. A Trusted Person in Portugal
Any Portuguese tax resident — a friend, colleague, or family member already living in Portugal — can serve as your fiscal representative. This is free but carries real liability: they become legally responsible for your tax compliance. Most people understandably decline.

The Application Process
Once you have a fiscal representative, the NIF application itself requires:
- A certified copy of your passport (apostilled if applying by post)
- Proof of your foreign address (utility bill or bank statement)
- A signed power of attorney (procuração) if someone is applying on your behalf
- The fiscal representative's own NIF and signed acceptance form
Applications can be submitted in person at any Finanças office, or remotely via the e-Balcão portal (though the online route still requires a fiscal representative to be nominated first).
The E-Balcão Portal
Portugal's e-Balcão (ebalcao.gov.pt) is the tax authority's online service desk. Once you have a NIF and fiscal representative set up, you can use e-Balcão to:
- Submit the Modelo 1 stamp duty declaration
- Check the status of tax filings
- Request copies of tax certificates
- Communicate with your assigned Finanças office
The portal operates in Portuguese, but most modern browsers provide adequate translation. Your fiscal representative can also submit filings on your behalf through their own e-Balcão account using your power of attorney.
Portal das Finanças for Inheritance
The broader Portal das Finanças (portaldasfinancas.gov.pt) is the central hub for all Portuguese tax matters. For inheritance specifically, this is where:
- The Cabeça de Casal files the death notification
- The Modelo 1 stamp duty declaration is submitted
- The NIF for the undivided estate (Herança Indivisa) is requested
- Tax clearance certificates are downloaded after stamp duty is settled
Access requires a NIF and a Portal das Finanças password (senha de acesso), which is sent by post to the fiscal representative's Portuguese address.
Timeline and Practical Tips
Start the fiscal representative and NIF process immediately after the death — ideally within the first two weeks. The three-month deadline for the Modelo 1 stamp duty filing runs regardless of whether all heirs have their NIFs sorted.
If multiple heirs need NIFs, coordinate through one lawyer or service provider to handle all applications simultaneously. Having five heirs each independently trying to arrange fiscal representatives creates chaos and delays.
