Portugal Bank Account Frozen After Death: How to Unfreeze Funds
Portugal Bank Account Frozen After Death: How to Unfreeze Funds
Your spouse died and the bank just froze everything — the joint account you've been paying bills from, the savings account, the investment portfolio. You can't access funds for funeral costs, rent, or daily expenses. This is one of the most distressing moments in Portuguese estate settlement, and it catches almost every foreign family off guard.
Why Banks Freeze Accounts
When a Portuguese bank receives formal notification of a customer's death, it's legally required to freeze all accounts held in the deceased's name. The freeze protects the estate: it prevents unauthorized withdrawals before heirs are legally identified and stamp duty obligations are assessed.
The bank acts as a deputy of the Autoridade Tributária (tax authority), ensuring that the assets remain intact until the Modelo 1 stamp duty declaration is filed and tax clearance is obtained.
Joint Accounts: The Painful Reality
In theory, joint accounts should be treated differently. The Lisbon Court of Appeal ruled in 2022 that surviving holders of joint and several accounts (contas solidárias) retain the contractual right to operate the full balance — the bank cannot legally block their access.
In practice, most Portuguese banks ignore this distinction. Their legal departments freeze the entire balance — not just the deceased's 50% share — to protect themselves from potential liability for unpaid stamp duty or claims by other heirs. You may have a legal right to access the funds, but the bank won't release them without formal probate documentation.
What You Need to Unfreeze
To release frozen accounts, you must present to the bank:
- The Assento de Óbito (official death certificate)
- The Habilitação de Herdeiros (deed of heir qualification, identifying all legal heirs)
- A written agreement signed by all verified heirs directing the distribution of the funds — typically notarized
- Proof of tax compliance — confirmation that the Modelo 1 stamp duty declaration has been filed with Finanças
Some banks also require a specific tax clearance certificate from the Autoridade Tributária before releasing any funds.
Finding Hidden Accounts
You may not know about every account the deceased held. To get a complete picture, the Cabeça de Casal (head of estate) should submit a formal query to the Banco de Portugal's Central Database of Bank Accounts (Base de Dados de Contas Bancárias).
This database lists every active current, savings, and securities account held in the deceased's name across all Portuguese financial institutions. To access it, you'll need:
- The deceased's NIF and full name
- The Assento de Óbito
- Proof that you're the Cabeça de Casal or an authorized heir
What the Database Doesn't Cover
The Banco de Portugal database has a critical gap: it doesn't include government debt instruments, savings certificates (Certificados de Aforro), or treasury certificates (Certificados do Tesouro). These are managed by the IGCP (Treasury and Public Debt Management Agency) and require a separate inquiry.

The 15-Year Forfeiture Rule
Under Decree-Law No. 187/70, if a deposit account remains completely inactive — no transactions, no legal claims — for a continuous period of 15 years, the entire balance is forfeited to the Portuguese State. This isn't theoretical: it happens to abandoned accounts of deceased expats whose heirs never knew the accounts existed.
If you suspect a relative who died years ago may have had Portuguese bank accounts, act immediately. The Banco de Portugal database search can confirm whether active accounts exist.
Bank Balance Certificates
Banks can charge for issuing balance certificates (certidões de saldo) needed for the stamp duty declaration. Portuguese law caps this fee at 10% of the IAS (Indexante dos Apoios Sociais) — approximately €53.71 in 2026. If a bank tries to charge more, they're exceeding the statutory cap.
Practical Steps to Protect Yourself
Before the freeze takes effect: If a death is expected (terminal illness, hospice care), understand that the moment the death is registered, all bank accounts will be frozen. Ensure the surviving spouse has access to a separate account in their own name for immediate living expenses.
After the freeze: The fastest path to unfreezing is completing the Habilitação de Herdeiros and filing the Modelo 1, which means the NIF Pack (all heirs' Portuguese tax numbers) must be assembled first.
