Tenancy After Death in Denmark: Lease, Deposit, and Property Clearance

When a tenant dies in Denmark, the rental lease does not end automatically. Under Section 163 of the Danish Tenancy Act (Lejeloven), the estate steps into the deceased's position — inheriting both the right to occupy and the full financial obligations of the lease. This catches many foreign families off guard, especially when they discover the estate owes three months' rent for an apartment nobody is living in.

Who Can Continue the Lease

Surviving spouse or registered partner: Absolute statutory right to continue the lease under identical terms. The landlord cannot increase the rent, demand a new deposit, or oppose the transition.

Cohabitants (2-year rule): If the deceased had no spouse, any person who shared the household for at least 2 years immediately before the death has the right to continue the lease. Proof requires registration at the same national registry address (folkeregisteradresse).

If neither applies, the lease must be terminated by the estate.

The 3-Month Notice Period

When no one continues the lease, the estate must terminate it in writing. The notice period is 3 months, starting from the first day of the month following the notice. During this period, the estate is fully liable for monthly rent, heating, and utility bills — even if the apartment is empty.

Example: If someone dies on July 10 and the estate sends termination notice on July 25, the 3-month period runs from August 1 through October 31. The estate owes rent through October.

The care home exception: If the deceased lived in a nursing home, care home (plejebolig), or elderly housing (ældrebolig), the notice period is reduced to 1 month, provided they lived alone.

The Security Deposit and Refurbishment

Danish rental contracts typically require the property to be returned in good condition — swept clean, painted, with sanded floors. Landlords use the security deposit (depositum) to cover refurbishment costs and will pursue the estate for any shortfall.

Key points for foreign families:

  • The landlord must file refurbishment claims via the digital estate portal within the 8-week proklama deadline published in Statstidende, or lose the right to claim against the estate
  • If final costs can't be calculated within 8 weeks, the landlord must submit a preliminary estimated claim within the deadline, followed by final costs in a subsequent 8-week window
  • Under boudlæg (estate under 55,000 DKK), the recipient of the estate can be required to clear out the apartment but is exempt from deep cleaning or cosmetic repairs

Property Clearance

Clearing the deceased's belongings is often one of the most emotionally difficult and logistically complex tasks for foreign families:

  • Furniture and personal effects: The estate must remove everything before the lease ends. Professional clearance services exist but add cost
  • The landlord cannot enter without permission: Even after the death, the landlord needs either the keys returned voluntarily or a bailiff court order to access the property
  • Heirs should not empty the apartment before getting the Probate Court Certificate — doing so without legal authority can create disputes about asset inventories

Utility Accounts and Other Registrations

Utilities, internet, and other subscription services don't terminate automatically:

  • Utilities: Contact providers directly to close accounts. Outstanding bills become claims against the estate
  • Car registration: A vehicle registered to the deceased must be re-registered or deregistered. The estate remains liable for insurance and registration fees until this is done
  • Digital Post: All electronic government and utility correspondence to the deceased is blocked the moment death is registered in CPR. The estate must petition the Probate Court for access to the deceased's digital correspondence

Sending the Termination Notice

The written termination must be sent by registered mail (anbefalet brev) or secure digital post to the landlord. Major public housing organisations (such as DAB Bolig) require the notice to be physically stamped by the Probate Court or accompanied by a certified copy of the Probate Court Certificate to be valid.
