Before you call a single agency or walk into a single office, gather your documents. In Louisiana, nearly every survivor benefit claim — from the Social Security Administration to the Office of Motor Vehicles — requires overlapping sets of paperwork, and showing up without the right documents means delays that can stretch from days to months.

The Foundation: Get Enough Death Certificates

Everything starts with certified copies of the death certificate. You will need more than you expect. Get 10 to 15 copies before you begin any claims process.

Where to get them:

  • Through the funeral director (easiest, within the first few days)
  • From the Louisiana Department of Health Vital Records: $7.00 per copy
  • From the Parish Clerk of Court: approximately $26.00 per copy (higher due to local surcharges)

The attending physician must complete the medical certification within 24 hours of death, and the funeral director must file the original certificate within five days. Louisiana is a closed-record state — only specific relatives (surviving spouse, parents, adult children, siblings, grandparents, grandchildren) can request certified copies.

Documents for Social Security (SSA)

  • Certified death certificate
  • Your Social Security card and the deceased's Social Security card
  • Your birth certificate
  • Marriage certificate (if claiming as a surviving spouse)
  • Divorce decree (if previously divorced, to confirm current marriage status)
  • Birth certificates of dependent children (if claiming on behalf of children)
  • Proof of citizenship or lawful alien status
  • W-2 forms or federal self-employment tax returns from the prior year

If the deceased was a Louisiana state employee or teacher covered by LASERS or TRSL, be prepared to explain this when applying — the Government Pension Offset may affect your benefit calculation.

Documents for LASERS (State Employees' Retirement System)

  • Certified death certificate
  • Marriage certificate
  • Birth certificates of any minor or disabled children who will be claiming benefits
  • Proof of disability for any child claiming benefits due to disability (State Medical Disability Board certification required)
  • LASERS membership information (member ID, last employer)
  • Form 04-05 (direct deposit authorization)
  • Form W-4P (federal income tax withholding election)

Documents for TRSL (Teachers' Retirement System)

  • Certified death certificate
  • Marriage certificate
  • Birth certificates of any minor children claiming benefits
  • School enrollment documentation if claiming for a student dependent (ages 21–23 must demonstrate full-time enrollment)
  • Disability certification if claiming for a child with a disability (acquired before age 21)
  • TRSL member information (employer name, employee ID)
  • Direct deposit authorization
  • Form W-4P (federal tax withholding)

TRSL will also want to confirm whether the deceased was in the TRSL Regular Plan or Plan B (School Food Service), as benefit structures differ. Plan B members' child benefits defer to the Social Security system.

Documents for Workers' Compensation (Workplace Death Claims)

  • Certified death certificate
  • Accident report or incident report from the employer
  • Medical records related to the workplace injury or illness
  • Evidence of dependency (marriage certificate for spouse; birth certificates for children)
  • Records of the deceased's average weekly wage (pay stubs, W-2 forms)
  • Medical records showing the final medical treatment date (the two-year prescriptive period runs from this date)

File with the employer's workers' compensation carrier. If the carrier disputes liability, the claim proceeds to the Office of Workers' Compensation (OWC).

Documents for VA Benefits (Veterans' Families)

  • Certified death certificate
  • DD Form 214 (Certificate of Release or Discharge from Active Duty) — this is the most critical military document; if lost, request it from the National Personnel Records Center
  • Marriage certificate
  • Proof of service-connected or non-service-connected death
  • Funeral home receipts and burial expense documentation
  • VA file number or claim number (if the veteran had a prior claim on file)

Non-service-connected burial claims must be filed within two years of the date of burial.

Documents for Bank Account Access

For the $10,000 surviving spouse withdrawal (La. R.S. 9:1513):

  • Certified death certificate
  • Your identification proving you are the surviving spouse
  • Marriage certificate

For the $20,000 intestate affidavit (La. R.S. 6:315.1):

  • Certified death certificate
  • Standardized affidavit (prepared by a notary) affirming: jurisdiction, family relationship, that the deceased left no will, and that total withdrawals across all institutions will not exceed $20,000
  • Identification for all signatories

For the Small Succession Affidavit (estates $125,000 or less):

  • Certified death certificate
  • Completed Small Succession Affidavit, notarized and signed by the surviving spouse and at least one major heir (or two heirs if no surviving spouse)
  • List of estate assets and their approximate values
  • For vehicle transfers: original vehicle title
  • For real estate: the affidavit must be recorded in the parish conveyance records

Documents for Office of Motor Vehicles (OMV) Vehicle Transfers

If using the Small Succession Affidavit pathway:

  • Small Succession Affidavit
  • Certified death certificate
  • Original vehicle title
  • Vehicle Application form (DPSMV 1799)

If using the Affidavit of Heirship for vehicles only (DPSMV 1696):

  • DPSMV 1696 (Affidavit of Heirship for motor vehicles)
  • Certified death certificate
  • Original vehicle title
  • Identification

The OMV title fee is $68.50 plus an $8.00 state handling fee. Transfer of a vehicle by inheritance is exempt from Louisiana state and local sales and use taxes.

Documents for Property Tax Relief (Parish Assessor)

Homestead exemption:

  • Proof of ownership or usufruct (succession documents or court order)
  • Proof that you occupy the property as your primary residence

Special Assessment Level freeze (age 65+ or disabled):

  • Proof of age (birth certificate or driver's license)
  • Prior-year tax return showing adjusted gross income below the current threshold ($100,000, indexed annually)
  • OR disability certification from the Social Security Administration or Veterans Affairs
  • OR DD Form 1300 (Report of Casualty) if claiming as the surviving spouse of a military member killed in action

Apply directly with your Parish Assessor. Each parish processes these applications independently.

Documents for the Employer (Final Wages Claim)

Dual-witnessed affidavit under La. R.S. 9:1515 containing:

  • Date and place of death of the deceased employee
  • Your relationship to the deceased (surviving spouse)
  • Names of other surviving children
  • Two witness signatures

The affidavit serves as a statutory receipt, releasing the employer from further liability for the wages paid. The employer must send an affidavit detailing the payment to the Louisiana Department of Revenue within 10 days.
