A springing Power of Attorney sounds like a perfect safety net — your agent gets no authority until you actually need them, activated only when a physician certifies you have lost mental capacity. In theory, this prevents misuse while preserving protection.

In practice, in New York, a springing POA creates exactly the kind of crisis it was designed to prevent.

How a Springing POA Works

Under GOL § 5-1501B(3)(b), a principal can create a Power of Attorney that remains dormant until a specified triggering event occurs. The most common trigger is a formal determination of mental incapacity by one or more licensed physicians.

Until that trigger is satisfied and documented, the agent has zero legal authority. They cannot access bank accounts, pay bills, sell property, or make any financial decisions on the principal's behalf.

The Problem: Proving the Trigger

When your agent walks into a bank with a springing POA, the bank will not accept it until the agent can produce written, signed physician certifications proving the principal lacks mental capacity. This creates several compounding problems:

Medical documentation takes time. Getting a formal capacity evaluation — especially from the specific physician(s) named in the POA — can take days or weeks. If the principal is hospitalized after a stroke, their primary care physician may not be available to issue the certification. If the POA requires two physicians to certify incapacity, the delay doubles.

Banks scrutinize the certification. Even after the agent obtains medical documentation, the bank's compliance department will review the physician's letter against the POA's triggering language. If there is any ambiguity about whether the stated condition has been met, the bank will reject the document and demand additional documentation or an attorney opinion — adding 10 or more business days to the process under GOL § 5-1504.

Bills do not wait. During the weeks it takes to activate a springing POA, mortgage payments go past due, utility bills accumulate late fees, insurance premiums lapse, and co-op maintenance charges accrue penalties. In New York City, a cooperative apartment can initiate eviction proceedings for unpaid maintenance in as little as 30 days.

Why Estate Planners Recommend Immediate Durable POAs

New York estate planning and elder law attorneys almost universally advise against springing POAs. Their recommendation is an immediate durable POA with structural safeguards:

The POA takes effect upon execution. The agent has authority from the moment they sign and notarize the "Important Information for the Agent" section. No trigger, no medical certification, no bank delays.

Safeguards replace the trigger. Instead of relying on a trigger to prevent misuse, the principal builds protection into the document:

  • Safekeeping: The principal holds the original POA and only releases it to the agent when the time comes. Without the original (or attorney-certified copy), a bank will not accept the document.
  • Monitor appointment: Under GOL § 5-1509, the principal can designate an independent Monitor — a trusted accountant, family member, or attorney — who has the statutory right to demand and audit the agent's financial records at any time.
  • Fiduciary duties: Under GOL § 5-1505, the agent is legally required to act in the principal's best interest, maintain separate assets, and keep detailed transaction records. Violations are actionable in court.

When a Springing POA Might Still Make Sense

There are narrow situations where a springing POA could be appropriate — for example, when the principal and agent live in different states and the principal wants a formalized medical trigger before the agent can act. But even in these cases, the delay risk usually outweighs the perceived safety benefit.
