A springing power of attorney sounds like the perfect compromise — your agent has no authority until you actually become incapacitated, so you stay in full control until a crisis hits. In practice, springing POAs create dangerous delays at the exact moment speed matters most.

How a Springing POA Works in Maine

Under 18-C M.R.S. § 5-902, a springing POA becomes effective only upon a triggering event defined in the document — typically the principal's incapacity. Unless the document specifies a different mechanism, the trigger requires a formal written determination of incapacity from the principal's primary treating physician.

The alternative is an immediate durable POA, which takes effect the moment it's signed and notarized. The agent has authority right away but doesn't have to exercise it. The document remains in a drawer until needed.

The Bank Problem

Here's where springing POAs break down in real life. Your parent has a stroke. You rush to their bank with the springing POA to pay the mortgage and utility bills before they're late. The bank's legal department asks one question: "Where's the physician's capacity determination?"

You don't have it yet. The attending physician at the hospital is managing your parent's acute care, not writing legal letters. You need to:

  1. Get the primary care physician to examine and evaluate your parent
  2. Wait for the physician to produce a written determination that meets the POA's triggering language
  3. Return to the bank with both the POA and the physician's letter
  4. Wait for the bank's legal department to review and accept both documents

This process takes days to weeks. Meanwhile, automatic payments bounce, the mortgage goes late, and credit card companies start calling.

When Banks Can Legally Refuse

A springing POA gives banks a legitimate basis for delay that an immediate POA doesn't. With an immediate durable POA plus the Agent's Certification form under 18-C M.R.S. § 5-951, the bank has a statutory obligation to accept the agent's authority. The agent certifies the POA is valid and in effect — there's no triggering question to investigate.

With a springing POA, the bank can reasonably ask whether the triggering event has occurred and demand documentation proving it. This isn't obstruction — it's due diligence.

When a Springing POA Makes Sense

A springing POA is appropriate in a narrow set of circumstances:

  • Principal is very young and healthy — Decades away from likely incapacity, the principal wants zero delegation until something actually happens
  • Principal has trust concerns — The relationship with the agent is new or hasn't been fully tested
  • Dual-agent structure — A springing POA to a secondary agent if the primary agent (who holds an immediate POA) becomes unavailable

For most Maine families — particularly those with an aging parent showing early signs of cognitive decline — an immediate durable POA stored securely is safer than a springing POA that creates a bureaucratic gauntlet during an emergency.

Emergency and Temporary POA

Maine doesn't have a separate "emergency POA" or "temporary POA" as distinct legal instruments. Instead:

  • Emergency situations — Use an immediate durable POA. The document can be signed and notarized the same day if needed.
