When You Genuinely Need a Lawyer

Not every enduring power of attorney needs a lawyer to draft it. But some situations genuinely benefit from legal advice:

Complex estates. If the donor owns multiple properties, has business interests, holds assets in multiple provinces, or has a blended family with competing interests, a lawyer can draft specific powers and restrictions that a template document can't anticipate.

Family conflict. If there's a realistic chance that family members will challenge the POA — disputing the donor's capacity, the choice of attorney, or the scope of authority — a lawyer's involvement creates a contemporaneous record of capacity assessment and voluntariness. That record is difficult to replicate with a self-prepared document.

Real estate transactions already pending. If the attorney needs to immediately sell or mortgage real property, a lawyer can prepare the EPOA, register it at Land Titles, handle any homestead compliance under The Homesteads Act, and close the transaction as a single engagement.

The donor's capacity is borderline. A lawyer trained in capacity assessment can evaluate whether the donor meets the legal threshold for understanding the nature and consequences of the document — and can document that assessment in a way that withstands later challenge.

When You Don't Need a Lawyer

For a straightforward enduring POA — one donor, one or two attorneys, standard financial authority, no unusual restrictions or conditions — the legal complexity is low. Manitoba's requirements are strict in who can witness the document, but the document itself is not structurally complex. The key elements are the enduring clause (so it survives incapacity), clear identification of the attorney, and proper Section 11 witnessing.

What you still need, even without a lawyer drafting the document, is a qualifying witness for the signing itself. A family physician, an RCMP officer, a justice of the peace, or a notary public can serve as the witness — the lawyer monopoly applies only to remote videoconference witnessing, not to in-person signing.
