Spanish Inheritance Tax for Non-Resident German Heirs
The Six-Month Clock Starts at Death
Spain imposes a strict six-month deadline from the date of death for filing and paying the Impuesto sobre Sucesiones y Donaciones (ISD) — the inheritance and gift tax. Miss it, and automatic surcharges of 5% to 20% apply, plus interest. Worse, missing the deadline can disqualify you from the generous regional tax reductions that might have reduced your liability to near zero.
For German heirs managing the aftermath of a relative's death in Spain, this deadline is one of the most consequential and most easily missed obligations in the entire process.
The Five-Month Extension Trap
Heirs can apply for a single six-month extension, doubling the total filing window to 12 months. But here's the catch: the extension request must be submitted within the first five months following the date of death. Applications filed in the sixth month are automatically rejected.
The extension postpones the filing deadline, but interest still accrues on the eventual tax payment from the original due date. Despite the interest cost, most cross-border estates need the extension — gathering documents from two countries, obtaining NIE numbers, and completing bank balance certifications rarely fits within six months.
Submit the extension to the Spanish Tax Agency (Agencia Tributaria) even if the estate inventory is incomplete. A timely application with incomplete data beats a complete filing that arrives late.
Regional Reductions Can Eliminate Your Tax Bill
Since a European Court of Justice ruling (case C-127/12), non-residents are entitled to apply the tax laws of the Spanish region where the deceased's assets are located. The differences between regions are dramatic:
Balearic Islands (Mallorca, Ibiza, Menorca): Direct heirs — spouses and children — enjoy a 100% tax reduction on inherited assets up to the statutory limit. For most family estates, the effective tax is zero.
Valencian Community (Costa Blanca, Alicante): A 99% tax reduction for direct descendants. A property worth €300,000 might generate an inheritance tax bill of just a few hundred euros.
Andalusia (Costa del Sol, Málaga): Similar generous reductions for close family members.
Regions without reductions: Under the national basic rates, inheritance tax runs from 7.65% to 34% on a progressive scale, with multipliers based on the heir's pre-existing wealth and kinship distance.
Which region's law applies depends on where the deceased lived or where the majority of their Spanish assets are physically located. Getting this determination wrong — filing under national rates when a regional reduction applies — leads to massive overpayment.

Double Taxation Between Spain and Germany
Germany and Spain have no bilateral double taxation treaty covering inheritance tax. This means an estate can theoretically be taxed in both countries. In practice, German law (Section 21 ErbStG) allows heirs to credit inheritance taxes paid to Spain against their German inheritance tax liability.
However, the credit is subject to limitations — it only applies if the Spanish tax matches the criteria of the German tax code. Working through the credit calculation typically requires a tax professional experienced in both jurisdictions.
On the German side, any heir who is a German tax resident must report the acquisition of foreign estate assets to their local Finanzamt within three months of learning about the inheritance (§30 ErbStG). This reporting duty applies regardless of whether any tax is actually owed in Germany.
You'll Need a NIE Number
Every heir must obtain a Spanish foreigner identification number (Número de Identidad de Extranjero — NIE) to access applicable regional inheritance-tax reductions. The NIE application can be submitted through a Spanish consulate in Germany, but processing takes several weeks to months. Start this immediately — a delayed NIE can prevent timely tax filing.
