Bank Refused Your Power of Attorney in Wyoming? Here's the Law on Your Side
You walk into the bank with a properly signed, notarized Wyoming power of attorney, and the teller says some version of: "We can't accept this — our legal department needs to review it," or worse, "You'll need to fill out our own POA form." In Wyoming, that answer is usually illegal — and the statute that makes it illegal gives you deadlines, a paper trail, and attorney's fees if they don't comply.
W.S. § 3-9-120: The Acceptance Deadlines
Wyoming's Uniform Power of Attorney Act doesn't just encourage banks to honor valid POAs — it orders them to, on a clock:
- 7 business days: After you present an acknowledged (notarized) POA, the bank must either accept it or request an Agent's Certification (the sworn statement under W.S. § 3-9-302), a translation, or an attorney's opinion letter.
- 5 business days: After they receive the requested certification or opinion, they must accept the POA.
- No proprietary-form demands: A bank cannot refuse your valid statutory POA and insist you use their in-house form instead.
These deadlines apply to banks, credit unions, brokerages, and other third parties alike.
When a Refusal IS Legal
The statute gives banks six legitimate escape hatches. A refusal is lawful only if:
- They're not otherwise required to do business with the principal;
- The transaction would violate federal law;
- They have actual knowledge the POA was revoked or terminated;
- You refused their request for an Agent's Certification;
- They hold a good-faith belief the document is invalid or the agent lacks authority for that specific transaction; or
- They've made a good-faith report of suspected elder exploitation to the Department of Family Services.
"Our policy requires our own form" is not on the list. "It's an old document" is not on the list. "Legal needs more time" past the deadlines is not on the list.
Your Step-by-Step Response
1. Stay at the counter and get the reason in writing. Ask what specific statutory ground they're relying on. Most refusals soften the moment the employee realizes you know § 3-9-120 exists.
2. Offer the Agent's Certification immediately. This is the sworn one-page statement (form at W.S. § 3-9-302) in which the agent certifies the POA is unrevoked and in full effect. Offering it on the spot eliminates the most common legitimate delay.
3. Send a written compliance letter. Cite the statute by number, attach the POA and certification, and state the deadlines: acceptance or valid objection within 7 business days of presentation, acceptance within 5 business days of receiving the certification. Send it to the branch manager and the institution's legal department. Date everything.
4. Escalate to court if they blow the deadline. Under § 3-9-120, a court can order the institution to accept the POA — and a bank that wrongfully refused is liable for your reasonable attorney's fees and costs in that proceeding. The fee-shifting provision is the leverage: once legal sees it, compliance usually follows quickly.

Prevention: The 7-Day Test While Everyone Is Healthy
The best time to fight this battle is before there's a crisis. When you execute a Wyoming POA, deliver copies to every bank and financial institution the principal uses immediately — while the principal can still walk in, confirm their intent, and sign the Agent's Certification if asked. The 7-day clock runs, problems surface, and they get resolved while nobody is in a hospital bed.
A POA that has already been accepted and is sitting in the bank's file is nearly refusal-proof. A POA presented for the first time during an emergency is where every horror story starts.
