India Income Tax Clearance Certificate for Deceased US Citizens

Before any money can leave India after a death, the estate must clear the Indian Income Tax Department. Banks and authorized dealers will not process an outward remittance without a tax clearance certificate — and the process of getting one is where families describe being "strung along" for months.

India Does Not Have an Inheritance Tax — But There Are Tax Obligations

India abolished its estate duty in 1985. Assets passing to heirs after a death are not subject to a separate inheritance or estate tax. Other Indian tax obligations can still apply to income, capital gains, and remittances. This is a common misconception among American families who assume India's tax system mirrors the U.S. framework.

What India does tax: the deceased's income earned up to the date of death. Rental income from Indian property, interest on NRO accounts, capital gains on mutual fund redemptions, and any other India-sourced income must be reported and taxes settled before the estate can repatriate funds.

For U.S. tax obligations on the same assets, the executor files IRS Form 706-NA if the deceased held U.S.-situs assets above the filing threshold. The Indian tax clearance and U.S. estate tax processes run independently — satisfying one does not satisfy the other.

Filing the Deceased's Final Indian Tax Return

The estate's legal representative must:

  1. Register as the legal representative with the Income Tax Department. File a request on the income tax e-filing portal, attaching the death certificate and the court order establishing authority over the estate.

  2. Obtain or activate the deceased's PAN. If the deceased had a Permanent Account Number, it remains valid for filing the final return. If the PAN has been cancelled (which happens automatically in some cases), the representative must apply for a new PAN in the name of the estate.

  3. File the final return. The return covers income from April 1 of the assessment year through the date of death. India-sourced income types that commonly appear in NRI estates:

    • Interest on NRO fixed deposits and savings accounts (subject to applicable tax withholding; the effective rate may be lower under the India-U.S. Double Taxation Avoidance Agreement)
    • Rental income from Indian real property
    • Capital gains on sale of mutual fund units or shares
    • Pension payments from Indian employers or government schemes
  4. Settle any tax liability. Pay outstanding dues through the e-filing portal's challan system.

The Lower Tax Deduction Certificate

Indian banks withhold tax at source (TDS) on NRO account interest. For many NRI estates, the actual tax liability is lower than the withholding amount, especially when the India-U.S. tax treaty reduces the applicable rate.

To avoid overpayment, the representative can apply for a Lower Tax Deduction Certificate (Section 197 of the Income Tax Act) from the jurisdictional Assessing Officer. This certificate instructs the bank to withhold at a reduced rate.

The catch: processing a Section 197 application can take months, and the Income Tax Department frequently requests supplementary documentation mid-process. Families on online forums describe the cycle of "submit, wait, receive a deficiency notice, resubmit, wait again" as one of the most frustrating parts of the Indian estate settlement.

If the timeline pressure is high and the estate's Indian income is modest, it may be more practical to accept the applicable withholding and claim any excess as a refund on the final return — but that does not eliminate the need to complete the tax-clearance process before repatriating funds.

Getting the Tax Clearance Certificate

Once the final return is filed and any tax due is paid, the representative applies for a tax clearance certificate. The certificate confirms that the estate has no outstanding Indian tax obligations. The authorized dealer bank requires this certificate and may also require the applicable Form 15CA and, where required, Form 15CB before it will process the international wire transfer.

The practical timeline from first filing to certificate in hand can run for months in straightforward cases and longer when the Assessing Officer raises queries or requests additional documentation.
