The 21-Day Window You Cannot Miss

Under India's Registration of Births and Deaths Act, 1969 (amended 2023), every death on Indian territory must be registered with the local municipal registrar within 21 days. The event can only be registered where the death physically occurred — if a US citizen dies in Hyderabad, the registration goes through the Greater Hyderabad Municipal Corporation, regardless of where the deceased was staying or where final rites take place.

Missing this window doesn't just add fees. It escalates the process into territory that can stall your entire repatriation and estate timeline.

What Happens When You Miss the Deadline

The penalties scale with delay:

22–30 days late: You pay a nominal late fee, but the registration still goes through the standard municipal process.

31 days to one year: The District Registrar must grant written permission. You submit a self-attested affidavit explaining the delay and pay an escalated fee.

Over one year: A formal order from a local Executive Magistrate is required, following a complete police verification of the death.

Over two years (under proposed legislative updates): A first-class Judicial Magistrate must issue a formal order.

At each escalation level, the family must first obtain a Non-Availability Certificate — an official document confirming that no prior record of the death exists in the municipal registry. Without this, the delayed registration cannot even begin.

City-Specific Processes

Each major Indian city runs its own registration system:

Delhi (MCD): Municipal Corporation of Delhi online portal. Heavy backlog with strict verification of hospital records and cremation slips. Institutional deaths (hospital) register faster than private-residence deaths.

Mumbai (BMC): MyBMC Civil Registration System. Manual verification required for older records. The BMC enforces strict matching of passport name spelling — any discrepancy between the passport and the death certificate triggers additional verification steps.

Hyderabad (GHMC): TS MeeSeva/CGG Portal. Requires physical submission at MeeSeva centers. The GHMC recently expanded to 300 wards, so jurisdiction identification can take extra steps if the death occurred in a newly incorporated area.

Kolkata (KMC): Janma Mrityu Tathya Portal. Compulsory registration within one year; beyond that requires a First Class Magistrate order.

Getting Certified Copies

Under Section 17 of the Act, any person can legally search the municipal death register and obtain certified extracts by paying the prescribed search fee. You will need multiple certified copies — the CRODA application, insurance claims, US probate courts, and Indian estate settlement each require their own original or certified copy.

If the death certificate is issued in a regional language (Marathi, Telugu, Bengali, or Hindi), you need a certified, notarized English translation before it can be used in any US legal proceeding or submitted for the MEA apostille.

Why This Document Matters Beyond India

The municipal death certificate is the foundation document. Without it, you cannot apply for the Consular Report of Death Abroad (CRODA). Without the CRODA, US banks, insurance companies, and probate courts will not recognize the death. And without the MEA apostille on the municipal certificate, US courts that require the primary foreign vital record will reject it.
