Why the 21-Day Window Matters

Indian law requires every death to be registered with the local municipal registrar within 21 days. If you miss this deadline, the process becomes significantly harder; the Registration of Births and Deaths (Amendment) Bill, 2026 proposes a tiered approval system for delayed registrations, and the delays cascade directly into UK probate, bank account freezes, and pension cancellations.

Within the 21-day window, registration is straightforward: submit the medical cause-of-death certificate and the deceased's identity documents, and the registrar issues the formal death certificate. Under the Bill's proposed framework, missing the window would lead to a tiered approval system:

• 21 days to 1 year: Written permission from the District Registrar plus a late fee
• 1 to 2 years: Requires an order from the District or Sub-Divisional Magistrate
• Beyond 2 years: Requires a formal order from a First-Class Judicial Magistrate — court hearings, police verification, witness testimonies

That last tier can add months to a process that should take weeks.

Which Office Handles the Registration

The registrar with jurisdiction depends on where the death occurred, not where the deceased lived:

• New Delhi: New Delhi Municipal Council (NDMC) or Municipal Corporation of Delhi (MCD)
• Mumbai: Brihanmumbai Municipal Corporation (BMC)
• Goa: Local village panchayat or municipal council
• Rural areas: Gram panchayat death registration — processing tends to be slower and record-keeping less standardised

For deaths in rural India, where the nearest registrar may be in a different town, start the clock from day one. The 21-day deadline does not flex for travel time or family logistics.

Documents Required for Registration

You need to bring:

1. Medical cause-of-death certificate from the hospital or post-mortem report from the government medical officer
2. Deceased's original UK passport
3. Visa or OCI card
4. Informant's identity documents (your passport and proof of UK residence)

The registrar's certificate records the deceased's name, date of death, place of death, address, and parents' names. It does not typically include the cause of death.

Get Five Certified Copies

Request at least five certified copies of the municipal death certificate at the time of registration. You'll need them for the MEA apostille, UK probate, each bank that holds the deceased's accounts, pension providers, and the Tell Us Once service.

Getting additional copies later is possible but involves returning to the same municipal office — difficult to manage from the UK.

Processing Time

Standard processing takes 10–15 working days from submission. Some municipal offices in major cities offer expedited services, but these aren't standardised.

What Makes UK Probate Reject an Indian Death Certificate

The municipal certificate on its own is not legally valid in the UK. It must go through the MEA apostille chain before UK courts, banks, or pension providers will accept it. The apostille process has its own sequence (notary → state Home Department/SDM attestation → MEA apostille sticker via BLS International or Superb Enterprises), and each step requires the original certificate.

Two things cause rejection at the probate stage: name spelling mismatches between the certificate and the UK passport, and certificates issued only in Hindi or a regional language without a certified English translation. Check the name spelling at the hospital level before the death certificate is issued — corrections after the fact require going back through the municipal office.
