When Bank Accounts Are Frozen and No POA Exists
A parent has a stroke. The bank freezes their accounts the moment it learns of the incapacity. Bills pile up. The care home wants payment. And the family discovers no power of attorney was ever registered.
Full guardianship takes three to six months and costs £5,000–£7,000. An intervention order addresses one specific decision but still requires a Sheriff Court application and medical reports. Meanwhile, the electricity bill is due next week.
This is where Scotland's Access to Funds (ATF) scheme fills the gap.
What the Access to Funds Scheme Is
Under Part 3 of the Adults with Incapacity (Scotland) Act 2000, the Office of the Public Guardian can authorise a designated individual, relative, or caring organisation to manage the adult's day-to-day finances. The scheme uses a dedicated bank account to receive authorised transfers from the adult's funds.
The scheme is designed as a temporary, proportionate measure. It covers day-to-day living expenses: utility bills, care fees, food, clothing, household costs. It is not intended for large capital transactions like selling property or restructuring investments — those need a guardianship or intervention order.
Who Can Apply
The applicant may be a designated individual, relative, or caring organisation.
The adult must lack capacity to manage their own financial affairs. The application includes a medical certificate of incapacity (Form SSI 51) and a fit-and-proper declaration from a referee who has known the applicant for at least one year.

How the Application Works
- Obtain the application form: the ATF application form is available from the OPG Scotland website or by contacting the Falkirk office directly.
- Complete the form: the applicant fills in their details, the adult's details, the bank accounts to be accessed, and an estimate of the adult's regular outgoings.
- Medical evidence and referee declaration: submit a medical certificate of incapacity (Form SSI 51) and a fit-and-proper declaration from a referee who has known the applicant for at least one year.
- Submit to the OPG: by post or email to the OPG Scotland in Falkirk. The registration fee is £110 (from 1 April 2026).
- OPG authorises the arrangement: once satisfied, the OPG authorises monthly transfers from the adult's funds to the dedicated account. Processing times vary but are typically faster than guardianship.
- Use the dedicated account: use authorised funds only for the adult's benefit and keep detailed records for the OPG.
Limits and Restrictions
The ATF scheme is deliberately limited:
- Transfer limit: the OPG authorises monthly transfers for the adult's day-to-day needs; follow the amount and purpose in the authority.
- Purpose restriction: funds can only be used for the adult's benefit. The OPG can request records of how the money was spent.
- Account and transaction scope: ATF is for routine bank access, household expenses, and care-home costs; a property sale or other large capital transaction needs an intervention order or guardianship.
- Longer-term needs: ATF is limited. Ongoing financial or welfare powers may require guardianship, while a POA can be arranged only while capacity remains.

The ATF scheme is a stopgap. It keeps the lights on while the family arranges a longer-term solution. If the adult's incapacity is likely permanent, guardianship will eventually be needed for anything beyond routine bills.
The Real Lesson
Every ATF application exists because a power of attorney was not set up in time. The OPG registration fee for a combined continuing and welfare POA is £99. A guardianship application — which becomes the only full-scope option once capacity is lost — costs fifty times that.
