Bank Refusing Power of Attorney in Wales — Your Rights and What to Do

Banks May Challenge or Delay a Registered LPA

A Lasting Power of Attorney stamped and registered by the Office of the Public Guardian is a legal document under the Mental Capacity Act 2005. Once registered, it gives the attorney statutory authority to act on the donor's behalf for financial matters (if it is a Property and Financial Affairs LPA).

Banks may still delay or reject a registered LPA in practice, for example because staff are unfamiliar with the document, because of minor clerical errors, or because of formatting issues on a copy.

Despite this, bank rejections happen regularly. The most common complaints involve branch staff who have never processed an LPA before, call centres that insist on speaking to the account holder directly (who may lack capacity), and requests for the attorney to provide documents that do not exist.

Why Banks Push Back

The pushback usually falls into a few categories:

"We need the original document." Some banks insist on seeing the original stamped LPA, not a certified copy. A bank may use this as a one-off verification step, but it becomes problematic when the bank wants to retain the original — you need it for other institutions too.

"We need to verify it with the OPG." Banks can check that an LPA is registered using the OPG's online service at gov.uk/manage-lasting-power-attorney/use-lasting-power-attorney. The donor or attorney can generate a digital access code that allows specific organisations to view the LPA online. If the bank does not use this service, ask it to explain its alternative verification process in writing.

"Our compliance team is reviewing it." Large banks route LPA registrations through specialist teams. The review can take additional time. During this time, the account may remain inaccessible — which defeats the purpose if you need to pay the donor's care home fees or mortgage.

"The LPA doesn't cover this account." A Property and Financial Affairs LPA covers the donor's financial matters subject to any restrictions in the document. If the bank says a particular account or transaction is outside the LPA, ask it to explain that position in writing.

How to Escalate

If a bank is refusing or unreasonably delaying recognition of your registered LPA:

Step 1: Put it in writing. Send a formal letter (or email to the bank's complaints address) stating:

  • You hold a registered Property and Financial Affairs LPA for [donor's name]
  • The OPG registration reference number
  • The specific action the bank is refusing or delaying
  • A request for the bank to confirm recognition within 14 days

Include a copy of the stamped LPA and ask the bank to explain in writing any verification issue or specific reason for refusing or delaying the request.

Step 2: Complain formally. If the bank does not resolve the issue within 14 days, submit a formal complaint through its published complaints procedure and follow the timetable it gives you.

Step 3: Financial Ombudsman Service. If the complaint remains unresolved or the bank issues a final response you disagree with, you can ask the Financial Ombudsman Service to review the complaint.

Rural Wales and Digital Access Codes

Bank branch closures hit rural Wales harder than most of the UK. If the nearest branch is an hour's drive and the bank wants you to present the original document in person, the OPG's digital access code system becomes essential.

Log in to the OPG's "Use a lasting power of attorney" service, generate a one-time access code, and provide it to the bank. This allows the bank to view and verify the LPA online without a branch visit. Not all banks have fully adopted this system yet, but the OPG actively encourages it, and citing the availability of the digital verification service strengthens any escalation.
