British Expat Dies in Portugal: The Process for Families Back in the UK

When a British expat dies in Portugal — not a tourist on holiday, but someone who lived there — the process is fundamentally different from a tourist death. The deceased has Portuguese bank accounts that freeze immediately. They may own property that triggers a three-month tax filing deadline. Their UK pension needs to be stopped. And you, their family in the UK, are likely managing all of this remotely.

The expat death process involves two parallel administrative tracks that run independently — one in Portugal, one in the UK — and neither system alerts you about the other's deadlines.

The Immediate Crisis: First 48 Hours

The 48-hour window for registering the death at a Portuguese Civil Registry Office (Conservatória) is the same for expats as for tourists. The funeral director handles the registration filing.

What differs for an expat death:

Bank accounts freeze immediately. Portuguese banks freeze the deceased's accounts as soon as they learn of the death. For joint accounts, the bank blocks the deceased's presumed 50% share; the surviving spouse may retain access to their portion, although some banks restrict all activity until formal credentials are produced.

The deceased has an existing NIF and tax record. Unlike a tourist, the expat was a Portuguese taxpayer. Their Portuguese tax obligations do not end at death — they transfer to the estate, and the Head of the Estate (Cabeça de Casal) inherits the responsibility for any unfiled returns and the three-month Modelo 1 filing.

Portuguese healthcare and social security records need to be closed. If the deceased was registered with a Portuguese health centre, receiving Portuguese social security benefits, or had a resident permit, these records must be updated.

The Three-Month Deadline That Catches Every Family

The Modelo 1 stamp duty declaration must be filed with Portuguese tax authorities (Finanças) by the end of the third month following the month of death. This deadline applies when the deceased had any Portuguese assets — property, bank accounts, vehicles, investments.

Direct heirs (spouse, children, parents) are exempt from the 10% stamp duty. The exemption does not excuse you from filing. Miss the deadline, and automatic penalties and interest accrue regardless of whether any tax is actually owed.

To file, the Cabeça de Casal needs:

  • Their own Portuguese NIF (non-resident heirs must apply for one; a fiscal representative or electronic-notification route may be required for some Portuguese tax relationships)
  • A NIF for the undivided inheritance estate (Herança Indivisa) if there are multiple heirs
  • The death certificate
  • A list of all Portuguese assets with estimated values

This is where remote management from the UK gets difficult. Non-resident NIF applications need to be started promptly. If the family delays, the three-month deadline becomes dangerously tight.

Managing from the UK: What You Can and Cannot Do Remotely

What you can do from the UK:

  • Notify the British Embassy in Lisbon (they provide consular guidance and referral lists)
  • Contact the deceased's travel or health insurer
  • Begin UK-side notifications (DWP, HMRC, pension providers, banks)
  • Instruct a Portuguese lawyer by email or phone (most cross-border estate firms operate in English)

What requires someone in Portugal (you, or a lawyer acting on your behalf):

  • Attending the Finanças office for NIF applications
  • Collecting apostilled documents from the PGR
  • Meeting the funeral director for repatriation or cremation logistics
  • Accessing the deceased's property and securing personal effects

A Portuguese lawyer with a signed power of attorney can handle nearly everything in the "requires presence" column on your behalf. Ask the lawyer how the power of attorney must be signed and legalised before they act.

The UK Track: Pension, Tax, and Probate

While the Portuguese estate track is running, the UK administrative machinery needs separate attention:

State Pension: Call the International Pension Centre to stop payments. Overpayments for the period after the date of death must be returned.

HMRC: Notify them to close the deceased's tax record. If the deceased was UK-non-resident but had UK rental income or a UK pension, HMRC may require a final tax return depending on the deceased's filing obligations.

UK Probate: If the deceased had UK assets (property, bank accounts, investments), a standard UK probate application proceeds using the apostilled Portuguese death certificate with a certified English translation. UK probate does not give you authority over Portuguese assets — those require the Portuguese Habilitação de Herdeiros process.

The disadvantage: during peak season, the consulate and funeral directors manage a higher volume of cases, and turnaround on non-urgent matters slows.
