Can a Bank Reject Power of Attorney in the NT?
You walk into a Darwin bank branch with a signed, witnessed, and registered Advance Personal Plan. The teller takes one look at the document, calls their manager, and tells you they need to send it to their legal compliance team interstate. Your parent's bills are overdue. The aged care facility is waiting for a deposit. And you are told to wait one to three weeks.
This happens more often in the Northern Territory than in any other Australian jurisdiction, and it is not because the documents are legally deficient. It is because the NT's combined APP format puts private medical information in front of bank staff who are only authorised to handle financial matters.
Why Banks Push Back
Commercial banks in Australia — ANZ, Westpac, CBA, NAB — have standardised internal processes for verifying powers of attorney. Those processes were designed for the single-purpose financial instruments used in New South Wales, Victoria, Queensland, and every other state. The NT's APP, which bundles banking authority with life-support refusals, palliative care directions, and residential care preferences, does not fit the template.
When a bank teller or branch manager encounters medical content in a financial authority document, the typical response is to escalate to the head office compliance team. That team may be in Sydney or Melbourne. They may be unfamiliar with NT law. And they will take their time.
A bank may scrutinise a valid, registered APP and delay processing while it verifies the document and authority. Under the Advance Personal Planning Act 2013, a properly executed APP can grant financial decision-making authority; the bank's internal review and processing speed remain separate questions.
The Escalation Steps
If a bank refuses or delays acceptance of your APP, you have several escalation options:
Step 1 — Request the refusal in writing. Ask the branch to provide a written statement explaining why they are not accepting the document. Most branches will not put an unlawful refusal on paper, which sometimes resolves the issue on the spot.
Step 2 — Contact the bank's POA processing unit directly. Each major bank has a dedicated unit for power of attorney documents. Bypass the branch entirely by calling the bank's central customer service line and asking to be transferred.
Step 3 — Lodge a complaint with the bank. Ask for the complaint reference and whether the matter can be taken to the Australian Financial Complaints Authority (AFCA) under its current eligibility rules.
Step 4 — Write to the bank's legal team citing the Act. A formal letter citing sections of the Advance Personal Planning Act 2013 and the APP's registration details (PGT registration number, LTO registration if applicable) puts the bank on notice that the document is legally valid.
The Prevention Strategy
The faster approach is to avoid the rejection entirely by using the split-document strategy: create two separate APPs, one covering financial matters only and the other covering healthcare and lifestyle decisions. Present only the financial APP to the bank. No medical content reaches the compliance team, and the document looks like the clean financial instruments they process every day from other states.
A pre-drafted banking cover letter — submitted alongside the financial APP — helps further. The letter identifies the decision-maker, confirms the APP's registration details, and specifies the accounts and transaction authority being activated. It gives the branch everything they need to process the document without escalation.
