CHAMPVA Eligibility After Veteran Death: Health Coverage for Surviving Spouses

CHAMPVA covered your medical bills while your veteran was alive because they were rated permanently and totally disabled. Now they've died, and you need to know whether that coverage disappears with them — especially if you're not old enough for Medicare and don't have employer insurance to fall back on.

The answer depends on why your veteran qualified you in the first place and whether you meet certain conditions as a survivor.

When CHAMPVA Continues After Death

You remain eligible for CHAMPVA as a surviving spouse if the veteran died from a service-connected condition or was rated permanently and totally disabled at the time of death. In either case, you must not be eligible for TRICARE — TRICARE enrollment blocks CHAMPVA by law.

If you were already enrolled in CHAMPVA before the veteran's death, your coverage doesn't automatically terminate. But you need to contact the CHAMPVA center at 1-800-733-8387 to update your enrollment status and provide the veteran's death certificate. Failing to update your record can cause claims processing delays.

If you weren't previously enrolled but now qualify as a survivor of a veteran who died from a service-connected cause, you can apply using VA Form 10-10d (Application for CHAMPVA Benefits). You'll need the veteran's death certificate, your marriage certificate, and the VA's rating decision or notification that the death was service-connected.

When CHAMPVA Ends

CHAMPVA eligibility terminates if you remarry before age 55. If you remarry at 55 or older, you retain CHAMPVA eligibility.

Enrollment in Medicare Part A doesn't disqualify you — in fact, CHAMPVA acts as secondary coverage alongside Medicare. But if you become eligible for TRICARE through another qualifying relationship, TRICARE takes precedence and CHAMPVA coverage terminates.

What CHAMPVA Covers

CHAMPVA covers most medically necessary services, including doctor visits, hospital stays, prescription drugs (through the Meds by Mail program), mental health services, and preventive care. The annual deductible is $50 per individual or $100 per family, and the cost share is 25% of the allowable amount after the deductible. There's a catastrophic cap of $3,000 per calendar year — once your out-of-pocket costs hit that limit, CHAMPVA pays 100% for the rest of the year.

The program does not cover dental care, most cosmetic procedures, or services provided outside the United States (with limited exceptions for emergencies).

The Coverage Gap Problem

There can be a gap between the veteran's death and the VA's formal determination that the death was service-connected. During this gap, new CHAMPVA applicants may not be able to get their enrollment processed because the VA hasn't yet issued the rating decision.

If you're caught in this situation, file your DIC claim (VA Form 21P-534EZ) as early as possible. Once the VA establishes service connection for the cause of death, that determination supports your CHAMPVA application. In the meantime, explore short-term coverage options through the Health Insurance Marketplace and ask whether you qualify for a special enrollment period.

CHAMPVA vs. TRICARE: Which One Applies

If you are eligible for TRICARE, you cannot use CHAMPVA. TRICARE survivors should contact DEERS at 1-800-538-9552 to update their status and ensure continued coverage.

CHAMPVA is specifically for dependents and survivors of veterans who were 100% permanently and totally disabled or died from service-connected causes, and who are not eligible for TRICARE.
