Statutory percentage. A few states (including California and Arkansas) set ordinary probate attorney fees by a tiered schedule tied to estate value. In California, a $5 million probate estate produces $63,000 in ordinary statutory attorney fees — before any extra services.

  • Estate income tax returns (Form 1041): $1,000 to $3,000 per year the estate remains open (often two to three years for farm estates)
  • Federal estate tax return (Form 706): $5,000 to $15,000 or more, depending on the complexity of the estate and whether special elections (2032A, 6166) are claimed

Executor Compensation

Family members serving as executor often waive compensation — but they should understand that an institutional executor (a bank or trust company) may charge 1% to 3% of the estate's value annually.

For a $3 million farm estate, a 2% fee would be $60,000 if that method applies under state law. Whether a fee is allowed and reasonable depends on the jurisdiction and court review; it can create friction among heirs who view it as an unfair windfall for the sibling who serves as executor.

Timeline and How It Affects Costs

Farm estate settlement timelines typically run:

  • Simple estates (clear title, no tax, cooperative heirs): 6 to 9 months
  • Standard estates (probate, appraisals, farm program transitions): 9 to 18 months
  • Complex estates (tax liability, contested will, partition risk, multiple states): 18 to 36 months
