You Do Not Need a Solicitor to Create an LPA

The most expensive misconception about Lasting Powers of Attorney is that you need a solicitor. You do not. But "do it yourself" does not mean "do it alone." Several organisations in Wales provide free guidance, support, and sometimes hands-on help with the process — and knowing where to find them can save families both money and mistakes.

Age Cymru

Age Cymru is the Welsh arm of Age UK and the most comprehensive free resource for LPA guidance in Wales. They offer:

• Factsheets written specifically for Wales (not rebadged English guides) — including detailed coverage of Welsh care funding thresholds, the £50,000 capital limit, and the £100 weekly home care cap
• Telephone advice through their helpline, staffed by trained advisors who understand the Welsh legal and care system
• Local branches (Age Cymru Gwent, Age Cymru Swansea Bay, etc.) that sometimes run face-to-face LPA workshops and drop-in sessions

Age Cymru's factsheets are free to download and reliably accurate on Welsh-specific points that national UK sources often get wrong — particularly the care funding thresholds, which differ significantly from England's.

Llais — The Independent Patient Voice for Wales

Llais (formerly the Community Health Council network) is Wales's independent body representing patients and service users in healthcare. While Llais does not draft LPAs, they provide free support on healthcare-related planning:

• Navigating the NHS Wales advance care planning process
• Connecting with local health board advocacy services
• Raising complaints about how healthcare providers handle LPAs

The Older People's Commissioner for Wales

The Commissioner's office is an independent statutory role focused on the rights and wellbeing of older people in Wales. They do not draft LPAs directly, but they:

• Publish guidance on the rights of older people in care settings
• Investigate systemic issues affecting older people's access to legal planning tools
• Advocate for policy changes that affect LPA accessibility (including digital access barriers for Welsh-language applicants)

If you are encountering structural barriers — such as a local authority refusing to explain the financial assessment, or a care provider not recognising a registered LPA — the Commissioner's office may be able to intervene or direct you to someone who can.

Local Authority Services

Every Welsh local authority has a duty under the Social Services and Well-being (Wales) Act 2014 to provide information, advice, and assistance about care and support needs. This includes:

• Explaining the financial assessment process and care funding thresholds
• Signposting to information and support about making an LPA
• Providing information about the Deferred Payment Agreement process
• Connecting families with local advocacy services

The quality of this support varies between councils, but the duty exists. If your local authority is not providing adequate information about how care funding interacts with power of attorney, you are entitled to ask for it.

Citizens Advice Cymru

Citizens Advice bureaux across Wales provide free, confidential advice on legal matters including LPAs. They can help with:

• Navigating the Court of Protection process if an LPA is not possible

Availability varies by location — some bureaux offer appointments, others operate on a drop-in basis. Check your local branch's website for current availability.

When Free Help Is Not Enough

Free resources cover the straightforward cases well. But some situations genuinely need professional legal advice: complex business assets, foreign property, family disputes over capacity, trusts, or situations where there is suspected attorney abuse.
