Hukou Cancellation After a Death in the US — What Chinese Families Must Do

Miss the Deadline and the Estate Freezes

When a Chinese citizen dies overseas, their household registration (户口) must be cancelled at the local public security bureau within one month of the death. This is not a formality — it is the administrative trigger that unlocks everything else: accessing bank accounts, initiating inheritance proceedings, collecting pension and social security benefits, and transferring property.

Failing to cancel the Hukou can block or delay formal probate, inheritance, property transfer, and pension or social security administration.

What You Need to Bring to the Public Security Bureau

The local police station (派出所) that holds the deceased's household register handles the cancellation. The person filing must bring:

1. The US death certificate with a state Apostille — Since November 2023, China accepts the Hague Apostille in place of the old consular legalization. The death certificate must be certified (not informational) and apostilled by the Secretary of State in the issuing US state.

2. A certified Chinese translation of the death certificate and Apostille — The PSB does not accept English documents. The translation must be done by a licensed translation agency in China (not a US translator) and authenticated by a local Chinese notary office (翻译公证). The translation, the original death certificate, and the Apostille must remain bound together — do not separate them.

3. The deceased's Chinese national identity card (居民身份证) — Bring the physical card if available; the police station will handle its cancellation.

4. The household register booklet (居民户口簿) — The deceased's entry is crossed out and stamped as cancelled.

5. The applicant's valid ID and proof of relationship — The person filing must be a family member listed in the same household register, or an authorized representative with a notarized Power of Attorney.

Start the One-Month Process Immediately

The one-month deadline runs from the date of death, not from delivery of the documents.

If documents are delayed, ask the local PSB what explanation or additional materials it requires; delays can hold up downstream estate administration.

What Happens After Cancellation

The PSB issues a Hukou Cancellation Certificate (户口注销证明). This document proves the person is officially deceased in China's civil registry. You will need it for:

• Bank account access: Chinese banks (Bank of China, ICBC, etc.) require the cancellation certificate before processing any estate claims on the deceased's accounts
• Inheritance proceedings: The notary office (公证处) that issues the Inheritance Right Certificate (继承权公证书) requires proof of Hukou cancellation
• Pension and social security: Any government benefits owed to the deceased or their survivors are processed only after the death is registered in the civil system
• Property transfer: Real estate registration offices require proof of death through the civil registry before transferring title

A Common Trap: The PSB Asks for Consular Legalization

Some local public security bureaus — particularly in smaller cities and rural areas — are still unfamiliar with the Hague Apostille format that replaced consular legalization in November 2023. They may ask for the old-style embassy stamp or reject the Apostille on sight.

If this happens, show the officer the Chinese Ministry of Foreign Affairs online verification portal (http://consular.mfa.gov.cn/VERIFY/) and the Apostille's unique registration number. This can help confirm the Apostille while the officer checks the post-2023 process.

If the officer still refuses, ask for a written rejection (驳回告知书) citing the specific regulation they believe requires consular legalization, then seek local PSB or Chinese legal advice about review or appeal.
