When Can an Attorney Act on an LPA in Wales?
An Unregistered LPA Has No Legal Force
A Lasting Power of Attorney signed by every party, witnessed correctly, and sitting in a drawer is legally meaningless. Until the Office of the Public Guardian (OPG) stamps and registers the document, no attorney can act under it — not for a bank transaction, not for a care home placement, not for anything.
Registration takes 8 to 12 weeks via the OPG's digital portal, or 12 to 16 weeks for paper applications. During that window, the document is in limbo. If the donor suffers a sudden stroke or cognitive decline before registration completes, the family faces a grim choice: wait for the OPG to finish processing, or abandon the LPA entirely and apply to the Court of Protection for a deputyship order at a cost of £432 in court fees alone — plus solicitor fees that routinely exceed £2,500.
That processing gap is why most solicitors and Age Cymru advisors recommend registering an LPA immediately after signing, not waiting until it is "needed."
The Two LPAs Activate Differently
Wales uses two types of LPA under the Mental Capacity Act 2005, and they follow different activation rules:
Property and Financial Affairs LPA (LP1F) can be used as soon as registration is complete — even while the donor retains full capacity. The donor can choose to restrict this by adding an instruction that the LPA should only take effect once they have lost capacity. But the default position is immediate availability, which is useful for practical convenience: managing bills while travelling, handling investments during a hospital stay, or simply having a trusted person able to step in without delay.
Health and Welfare LPA (LP1H) can only be used after a qualified medical professional has confirmed that the donor lacks mental capacity to make the specific decision in question. The attorney cannot make healthcare or care placement decisions while the donor is still capable of deciding for themselves. This is a hard legal boundary, not a preference.
What "Losing Capacity" Actually Means
Capacity is not binary. Under the Mental Capacity Act 2005, it is assessed per decision and per moment. A person with early-stage dementia may lack capacity to manage a complex property sale while retaining full capacity to decide what they eat for dinner or whether to move to a care home.
For a Health and Welfare LPA to activate, a healthcare professional must assess that the donor cannot:
- Understand the information relevant to the specific decision
- Retain that information long enough to make the decision
- Use or weigh that information as part of the decision-making process
- Communicate their decision (by any means)
If the donor fails any one of those four elements for a particular decision, the attorney gains authority to make that specific decision on their behalf. But the attorney's power does not extend to decisions the donor can still make independently.

Using a Registered Financial LPA at Banks
Once a Property and Financial Affairs LPA is registered and the attorney needs to act, they present the stamped document (or its digital access code via the OPG's "Use a lasting power of attorney" service) to the relevant institution. A valid registered LPA gives the attorney authority under the Mental Capacity Act 2005, but banks, building societies, and investment platforms may still request internal paperwork or insist on seeing original or certified documents.
In practice, some institutions request their own internal paperwork or insist on seeing original documents rather than certified copies. This causes delays but does not change the attorney's legal authority. If a bank refuses to accept a registered LPA, the attorney can escalate through the institution's complaints process and, if necessary, to the Financial Ombudsman Service.
Register Early — The Window Closes Without Warning
The single most important practical lesson: register both LPAs as soon as they are signed. The donor must still have mental capacity at the point of application — if capacity is lost before the OPG receives a valid application, the document cannot be registered at all.
There is no emergency fast-track at the OPG. Families who delay registration until a crisis has already begun often discover they are too late, and the only remaining route is the Court of Protection deputyship process: more expensive, more invasive, and controlled by a judge rather than the family's own choices.
