No Power of Attorney and Capacity Lost in the NT: What Happens Next

A parent in Darwin or Alice Springs suffers a stroke. They cannot communicate, cannot sign documents, and cannot make decisions about their finances or care. There is no Advance Personal Plan. No legacy Enduring Power of Attorney from before 2014. No one in the family has automatic authority over the bank accounts or property; healthcare decisions follow the statutory hierarchy.

This is the scenario the Advance Personal Planning Act 2013 was designed to prevent. When it happens anyway, the family faces a significantly harder and more expensive path to financial or lifestyle authority they could have arranged for free; healthcare decisions may instead follow the statutory hierarchy.

Healthcare Decisions Still Happen

The one area that does not require a tribunal application is healthcare. The NT uses a statutory healthcare decision-maker hierarchy, and treating doctors will work through it automatically:

  1. Spouse or de facto partner
  2. Primary carer of the adult
  3. Close relative or friend

A doctor will identify the highest-ranked available person who is willing and able to act and seek their consent for treatment. This hierarchy operates by default — no court order or paperwork is needed.

But this covers medical decisions only. The hierarchy gives no one authority to access the parent's bank accounts, pay their bills, manage their property, or arrange their move into residential aged care.

Financial and Lifestyle Decisions Require NTCAT

For anything beyond healthcare, the family must apply to the Northern Territory Civil and Administrative Tribunal for a guardianship order. The process:

  1. File Form AG1 (Application for Guardianship Order) — no filing fee
  2. Obtain a medical capacity report (Form AG3) from the treating doctor
  3. The proposed guardian files Form AG2 (declaration of eligibility)
  4. Attend a tribunal hearing

The hearing determines whether a guardianship order is appropriate and who should be appointed. The best-case outcome is that a family member is appointed with the specific authority needed. The worse case is that the tribunal appoints the Public Guardian or Public Trustee, removing family control entirely.

The Financial Cost of No Planning

While the NTCAT application itself is free, the downstream costs can be significant:

Public Trustee administration fees. If the Public Trustee is appointed to manage the adult's finances, fees may apply; the applicable fees depend on the service being provided.

Frozen accounts. Until the guardianship order is issued, bank accounts remain inaccessible. Bills go unpaid. Aged care invoices accumulate. If the adult owns a business, operations stall.

Legal fees. While the NTCAT process can be navigated without a lawyer, many families engage one for the hearing, particularly if there are disputes between family members. Solicitor fees in Darwin typically run $400–$1,200 for guardianship matters.

Time. NTCAT hearings are scheduled based on tribunal availability. The waiting period adds weeks or months to a situation that is already urgent.

The Window Is Smaller Than You Think

Cognitive decline is rarely sudden. In most cases — dementia, Alzheimer's, age-related deterioration — there is a period where the parent is still capable of understanding and signing an APP, even if their capacity is declining. That window is the opportunity.

An APP can be executed at any time while the maker has decision-making capacity. The authorised witness must certify that the maker appears to understand the document and is acting voluntarily. Early-stage cognitive impairment does not automatically disqualify someone from making an APP — capacity is assessed on a decision-by-decision basis.

Once the window closes, it closes permanently. No family member can create an APP on someone else's behalf.
