The Foreign Death Certificate Is Your Proof of Death

When an Australian citizen dies in Indonesia, the family needs to prove the death to an Australian supreme court before they can collect, manage, or distribute estate assets — bank balances, share portfolios, real estate, superannuation. The proof is the Indonesian Akta Kematian, but only after it has been apostilled by Kemenkumham and translated by a NAATI-accredited translator.

Without all three documents presented together, the court will reject the probate application.

What the Supreme Court Requires

To apply for a Grant of Probate (if there is a valid will) or Letters of Administration (if there is no will), the executor submits:

• The original Akta Kematian bearing the Kemenkumham Apostille
• The NAATI-certified English translation
• The original will (if one exists)
• The executor's identification documents

The court verifies the Apostille under the Hague Convention. Because Indonesia is a convention member (since June 2022), no additional embassy legalisation is needed — the Apostille alone authenticates the document.

One critical rule: foreign probate grants issued by Indonesian courts cannot be "resealed" in Australia. If the deceased held assets in both countries, the executor must apply for a completely fresh, original Grant of Probate in the relevant Australian state. An Indonesian court order cannot be imported.

Do You Need to Register the Death with an Australian BDM?

In most cases, no. If the deceased was a resident of NSW, Queensland, or most other states, there is no legal requirement to register an overseas death with the state Registry of Births, Deaths and Marriages. The apostilled, translated foreign death certificate serves as the primary legal proof of death for all purposes — probate, banking, insurance, and government notifications.

However, some states offer optional registration:

Victoria: The Victorian BDM will register an overseas death if the deceased normally lived in Victoria or owned property there. The family must provide a statutory declaration, the deceased's Australian passport, proof of Victorian residency (12 months of utility bills or rates notices), and the translated Akta Kematian.

Western Australia: Under Section 40 of the Births, Deaths and Marriages Registration Act 1998, an overseas death may be registered if the deceased was ordinarily resident or domiciled in WA, or owned property there.

NSW: The NSW BDM generally directs families to use the foreign death certificate directly rather than registering the death locally.

Registration is optional and does not affect the validity of the Indonesian certificate for probate purposes. The main benefit is having an Australian-issued death certificate for institutions that are unfamiliar with foreign documents.

Common Mistakes That Delay Probate

Three errors account for most probate delays when the death occurred overseas:

1. Submitting the Akta Kematian without the Apostille — the court returns it immediately
2. Using an uncertified translation — anything without a NAATI stamp, credential number, and translator signature gets rejected
3. Assuming a single certified copy is enough — the court, the bank, and the super fund all want to see originals or independently certified copies simultaneously; plan for multiple certified copies of the translated certificate
