What Changed After Brexit

While the UK was an EU member, Spanish public documents moved freely between jurisdictions under EU Regulation 2016/1191, which exempted certain civil-status documents from legalisation. A Spanish death certificate could be presented to a UK institution with minimal formality.

That exemption ended on 31 December 2020. Since then, Spanish documents needed for UK estate, pension, or probate administration may need the full Hague Convention legalisation sequence before a UK bank, insurer, or the Probate Registry will accept them.

The Mandatory Apostille-Then-Translation Sequence

The order matters. Getting it wrong means paying for the same translation twice and losing weeks:

1. Obtain the literal death certificate (Certificado Literal de Defunción) from the Spanish Registro Civil. This is the full registry copy — not the short extract, and not the multilingual Vienna Convention certificate. For UK estate administration, request the literal version because institutions may require it.
2. Affix the Hague Apostille to the physical certificate. The issuing authority is the Spanish Ministry of Justice (Ministerio de Justicia), the regional Tribunal Superior de Justicia, or the delegated Colegio Notarial. Digital certificates can receive an electronic apostille via the Ministry's Sede Electrónica. There is no government fee.
3. Commission a sworn translation (traducción jurada) of the entire document — including the apostille stamp itself. The translator must be registered with Spain's Ministry of Foreign Affairs (MAEC) as a traductor-intérprete jurado.

If you translate first and apostille second, UK authorities will reject the package. The translator must translate the apostille, which means the apostille must already be on the document when the translation is produced.

The Multilingual Certificate Trap

Families frequently make an expensive mistake at this stage. Spain's Registro Civil can issue a multilingual death certificate (Certificado Plurilingüe) under the 1976 Vienna Convention, with pre-translated headings in several European languages including English. It looks ready to use.

It is not a reliable substitute. Post-Brexit, UK financial institutions and the Probate Registry may require the literal certificate — the complete, unabridged registry copy — with apostille and sworn translation. The multilingual version may lack the detail an institution needs for estate administration, so confirm the required format before ordering.

UK Documents Going to Spain

The legalisation requirement runs both directions. If you need to present a UK Grant of Probate, a UK birth or marriage certificate, or a UK power of attorney in Spain:

• The document must be apostilled by the UK FCDO (Foreign, Commonwealth & Development Office)
• It must then be translated into Spanish by a traductor jurado
• For documents that require legalisation, this is the sequence Spanish courts, banks, and notaries may require; confirm the receiving institution's requirements

For UK probate applications using a foreign death certificate, personal applicants submit Form PA19 alongside the translated certificate. If a licensed translation company handles the work, Form PA19 is not required — the company provides its own certificate of accuracy.

How This Affects Timelines

The Spanish apostille may be issued instantly through the digital route or take up to 5 days by post; a sworn translation can take 24 hours to 5 days.
