A power of attorney (Surat Kuasa) in Indonesia terminates automatically upon the death of the principal. This catches many foreign families off guard — the person who held POA to manage bank accounts, sign property documents, or deal with government agencies suddenly has zero legal authority the moment the principal dies.
Why a Surat Kuasa Dies With the Principal
Under the Indonesian Civil Code (KUHPerdata), a power of attorney is a personal mandate that expires upon the death of either party. Banks enforce this strictly. The moment they receive notification of a depositor's death, they freeze all accounts and suspend ATM access, online banking, and standing debit orders — regardless of who held power of attorney over those accounts.
This creates a particularly harsh situation for surviving spouses in mixed marriages. If the Indonesian spouse managed household finances through a joint account and the foreign spouse held power of attorney, that authority vanishes instantly. The surviving foreign spouse is locked out of household funds needed for staff salaries, rent, and even groceries.
What Replaces a POA After Death
After death, legal authority over the estate passes through Indonesia's heir certification system. Depending on the deceased's classification, this means:
A Certificate of Inheritance (Surat Keterangan Ahli Waris) drafted by a Notary, issued by the Kelurahan, or obtained from the Heritage Office (BHP). This document identifies the legal heirs and grants them collective authority to act on the estate.
A Court Determination (Penetapan Ahli Waris) from the Religious Court (Muslim deceased) or District Court (non-Muslim deceased). Required for disputed estates or when bank balances exceed Rp 10,000,000.
A Letter of Indemnity signed by all heirs, releasing the bank from liability if a future inheritance dispute arises. Banks require this before disbursing any funds.
The key difference: a POA authorises one person to act on behalf of a living principal. The inheritance certificate authorises all identified heirs collectively. Every heir must sign off on major transactions.
Can You Grant a New POA From Abroad?
Yes — heirs who cannot travel to Indonesia can grant a Surat Kuasa Khusus (Special Power of Attorney) to a trusted representative in Indonesia to handle estate administration on their behalf. This is essential for remote adult children managing a deceased parent's estate from overseas.
The new POA must be:
- Notarised in the heir's home country
- Apostilled under the Hague Convention (or legalised through the Indonesian embassy if the country isn't a Hague member)
- Translated by a sworn Indonesian translator (Penerjemah Tersumpah)
- Registered with a licensed Indonesian Notary
This translated, registered POA then allows the representative to appear before banks, land offices, and courts on the heir's behalf.

Planning Ahead: What Actually Protects Assets
Since a POA dies with the principal, the only reliable protections are arrangements that don't depend on the POA holder's survival:
