Register Power of Attorney Land Titles Office Darwin

If your Advance Personal Plan or General Power of Attorney is to be used for transactions involving real property in the Northern Territory, it must be registered with the Land Titles Office before your decision-maker can sign a single transfer form. This is not optional. An unregistered instrument has no legal effect for property transactions, regardless of how correctly it was executed.

When LTO Registration Is Required

LTO registration is mandatory when the decision-maker needs to:

• Sell real property on behalf of the maker
• Purchase property in the maker's name
• Mortgage or refinance property
• Transfer a property title
• Sign any land titles form on the maker's behalf

If the APP or GPOA does not touch property, LTO registration is not required. For an APP, PGT registration (which is free) is available for non-property matters.

What to Submit

You need to lodge the original executed document — not a copy — with the LTO. For an APP, this means the original signed and witnessed plan. For a GPOA, this means the original Form 38.

The Paper Requirements That Trip People Up

The LTO enforces strict formatting requirements under the Registrar-General's Directions. These are not suggestions — non-compliant documents are rejected or hit with a requisition fee of $35.

Paper weight. All documents must be printed on international white A4 paper with a minimum weight of 80 gsm. Standard home printer paper is typically 75 gsm, which means you may need to specifically purchase 80 gsm stock.

Double-sided printing. Documents must be printed double-sided. If you lodge a single-sided document, the LTO will reject it or charge the requisition fee. This is the single most common reason for rejection — people print the APP at home, single-sided, and assume it will be accepted.

Legibility. Text must be clearly legible, printed in black ink. Alterations should be crossed out and initialled by the parties.

Current Fees

LTO fees are calculated using "revenue units" — a statutory value updated annually on 1 July based on Darwin's Consumer Price Index. For the 2026–2027 financial year, one revenue unit equals $1.49.

The APP registration fee is significantly higher than the GPOA fee because the APP carries broader authority (financial, healthcare, and lifestyle). The fee applies per registration — if you are using the split-document strategy (separate financial and healthcare APPs), only the financial APP needs LTO registration.

The Registration Gap Problem

The scenario that creates the most stress: a family sets up an APP years ago, registers it with the PGT (free, easy), and assumes they are covered. Years later, the maker loses capacity and needs to move into aged care. The decision-maker tries to sell the family home to fund the care — and discovers the APP was never registered with the LTO. No registration means no legal authority to sign transfer documents.

At this point, the decision-maker must register the original APP with the LTO and pay the fee before the property transaction can proceed. If the original document has been lost, the situation becomes significantly more complicated — potentially requiring an NTCAT application to confirm the plan's existence.

The fix is simple: register with the LTO at the same time you register with the PGT, even if property transactions seem unlikely at the time. The ~$171 fee is trivial compared to the cost of an urgent NTCAT application.
