What Happens When Someone Dies in a Car Crash

The phone call comes without warning. A police officer, a hospital chaplain, or a stranger's voice tells you that someone you love was killed in a car accident — and from that moment forward, a cascade of institutional processes begins moving whether you are ready or not.

What Happens at the Crash Scene

When a fatal collision occurs, responding officers secure the scene and call the county medical examiner or coroner. In the United States, any death involving physical trauma is classified as a non-natural death and triggers a mandatory forensic investigation. The medical examiner takes jurisdiction over the body, which means the family cannot authorize its release until the examination is complete.

Law enforcement will document the scene — photographing skid marks, debris fields, and vehicle positions. If the crash involves suspected impairment or disputed liability, officers may impound both vehicles as evidence. Personal belongings inside the vehicle are typically recoverable, but you may need to present identification and proof of your relationship to the deceased.

The responding agency will generate a crash report; availability depends on the agency and whether an investigation is active. You can request a copy from the local police department or state DMV. The report may be redacted under the federal Driver's Privacy Protection Act.

The Medical Examiner and the "Pending" Death Certificate

The medical examiner or coroner determines the cause and manner of death. In straightforward cases, the physical examination and body release happen within 24 to 48 hours. But toxicology testing — standard in all traffic fatalities — typically takes eight to twelve weeks to finalize.

Until those results come back, the death certificate is issued with the cause of death marked as "Pending." This creates a real financial problem: most banks, life insurance companies, and pension administrators will not release funds based on a pending certificate. If you need access to accounts during this window, ask the medical examiner's office for a formal Proof of Death Letter, which some financial institutions will accept as interim documentation.

The Vehicle, the Tow Yard, and Evidence You Cannot Lose

After the scene is cleared, the vehicle is towed to a private storage lot or municipal impound facility. Daily storage fees begin accruing immediately — often $50 to $75 per day — and unauthorized "bandit" tow operators sometimes arrive at crash scenes uninvited, charging inflated rates.

More critically, the vehicle may contain irreplaceable evidence. Many newer cars have an Event Data Recorder that can capture speed, braking, throttle position, and seatbelt status in the seconds before impact. Federal rules standardize data from vehicles equipped with an EDR but do not require every vehicle to have one. The data can be overwritten if the ignition is cycled or the vehicle is released to a salvage yard.

Do not sign a salvage release from the insurance company until an independent expert has downloaded the EDR data. If a wrongful death claim is even a possibility, your attorney should send a formal spoliation letter to the tow yard, the insurance carrier, and any commercial fleet owners involved, putting them on notice that litigation is anticipated and that evidence may need to be preserved. A court may impose sanctions if evidence that should have been preserved is destroyed.

Insurance Claims and Immediate Financial Relief

Several insurance mechanisms can provide funds in the first weeks:

Personal Injury Protection (PIP): Florida law provides a $5,000 PIP death benefit. It may be paid to the executor or administrator, certain relatives, or another person the insurer considers equitably entitled; ask the insurer which documents it requires.

Medical Payments Coverage (MedPay): Optional coverage that can pay medical and funeral expenses directly resulting from the crash, regardless of fault. Limits depend on the policy.

Uninsured/Underinsured Motorist Coverage (UM/UIM): If the at-fault driver had no insurance or insufficient coverage, your loved one's own UM/UIM policy fills the gap.
