Why US Institutions Demand an Apostille

A UK death certificate is a foreign public document. Without additional authentication, many US banks, probate courts, and insurance companies will reject it. The Hague Apostille — a certification stamp from the UK's Foreign, Commonwealth and Development Office (FCDO) — is what gives the certificate legal standing in the US system.

The apostille doesn't verify the facts on the certificate. It certifies that the document is a genuine public record issued by an authorized UK authority. Once apostilled, the death certificate can be presented for legal recognition in the United States, including in probate matters.

The e-Apostille Trap

The FCDO offers a fast, electronic e-Apostille service for certain documents. Families in a hurry often see this online option and assume it will work for a death certificate.

It won't. UK death certificates issued by the General Register Office or local registrars are explicitly excluded from the e-Apostille service. Submitting a death certificate for an e-Apostille results in immediate rejection, loss of the processing fee, and several days of wasted time — exactly the delay families managing a repatriation can't afford.

The only valid route is the traditional paper-based apostille.

How the Paper Apostille Process Works

1. Get a certified copy of the death certificate from the local registrar or, if ordering replacements, from the GRO online portal. The FCDO will only apostille original certified copies — not photocopies, not digital scans, not solicitor-certified versions.

2. Mail the certificate to the FCDO Legalisation Office at PO Box 6255, Milton Keynes, MK10 1XX. Send it via Royal Mail Special Delivery or a tracked courier — this is an original document you cannot replace quickly if it's lost in transit.

3. Wait for processing. Standard DIY postal submissions take two to three weeks. The FCDO physically attaches the apostille certificate to the original document and mails it back.

4. Receive the bound document. The apostilled certificate arrives as a single legal instrument — the original death certificate physically attached to the apostille page. Do not separate them.

Express Options

For families on tight probate deadlines, registered apostille agents in the UK offer expedited service. These agents have daily counter access to the FCDO office in Milton Keynes and can secure:

• Same-day service — document submitted in the morning, apostilled and collected the same afternoon
• Next-business-day service — document submitted one day, returned the next

Agent fees typically run £50–£150 on top of the FCDO's standard apostille fee. Given that a two-to-three-week delay can stall US estate proceedings, probate filings, and insurance payouts, the express cost is often worth it.

How Many Apostilled Copies Do You Need?

At minimum, two: one for the US probate court filing and one for the most demanding financial institution (typically the bank holding the largest account). If you're filing insurance claims with multiple carriers, each may want its own original apostilled copy.

Order extra certified death certificates at the time of registration — they're cheapest then — and submit multiple copies to the FCDO simultaneously. Each one gets its own apostille.

Some US institutions accept a CRODA (Consular Report of Death Abroad) instead of an apostilled UK death certificate. If you have both, lead with the CRODA for federal agencies and the apostilled certificate for state courts and banks. Having both documents ready prevents the back-and-forth that adds weeks to estate settlement.
