Getting the Signing Order Wrong
This is the single most common cause of OPG rejections. The Mental Capacity Act 2005 mandates a strict chronological sequence:
- The donor signs Section 9 first
- The certificate provider signs Section 10 on the same day or after
- Each attorney and replacement attorney signs Section 11 after the certificate provider has completed Section 10
If an attorney signs before the certificate provider dates their section, the entire LPA is invalid. Not "needs a correction" — invalid. You have to start the whole application from scratch.
The dates on each section are what the OPG checks. Even if everyone was physically present on the same day, a backdated or incorrectly ordered date will trigger a rejection.
Using an Ineligible Certificate Provider
The certificate provider confirms that the donor understands the LPA and is not being pressured into signing. They must be either a professional (solicitor, GP, registered healthcare professional) or someone who has known the donor personally for at least two years.
People who cannot act as certificate provider:
- Any named attorney or replacement attorney
- A family member of the donor
- A family member of any attorney
- An employee of a care home where the donor lives
- A business partner of the donor or any attorney
- Anyone under 18
Choosing someone who falls into these categories means an automatic rejection and a fresh application.

Witness Eligibility Errors
Every signature on an LPA needs a witness, but the rules about who can witness whom catch people out:
- Attorneys cannot witness the donor's signature — this is the most common witness error
- The donor cannot witness an attorney's signature
- An attorney cannot witness another attorney's signature
- Any independent adult over 18 can serve as a witness, but they must be physically present when the person signs
One witness can technically witness multiple signatures in the same LPA, as long as they are not disqualified by the relationships above.
Correction Fluid and Crossed-Out Entries
The OPG does not accept LPA forms with correction fluid (Tipp-Ex), heavy crossings-out, or unclear amendments. If you make an error on a paper form, the safest approach is to print and complete a fresh section.
For minor corrections — a wrong date, a misspelled name — you can draw a single line through the error, write the correction above it, and have both the person who made the entry and their witness initial the change. But caseworkers have wide discretion here, and anything that looks unclear or suspicious will delay the application.
Missing the Fee Support Deadline
Since February 2026, the OPG no longer accepts retrospective fee remission applications. If you qualify for reduced fees — Universal Credit claimants now need to prove gross annual income under £12,000 for a 50% remission — Form LPA120 must be submitted at the exact time of the LPA registration application, along with 12 months of consecutive Universal Credit statements.
Miss that window, and you pay the full £92 per document regardless of your financial situation.
