What "Pending" on a Death Certificate Means
When a death certificate lists the cause of death as "pending," it means the medical examiner or coroner has not yet determined the official cause and manner of death. This happens when additional testing is needed — most commonly toxicology screening, neuropathological examination, or histological analysis of tissue samples.
After a sudden death from a suspected heart attack, stroke, or aneurysm, the certifier may list the cause as pending while additional tests are completed. A pending designation alone does not mean that something suspicious happened.
But a pending designation can delay some of the family's next steps. Insurers, banks, probate courts, and pension administrators may wait for an amended certificate before deciding a claim or transferring assets.
Why Toxicology Takes So Long
Forensic toxicology is not a single test. The lab runs a sequence of screenings, starting with broad immunoassay panels for common drugs and alcohol, then moving to confirmatory testing using gas chromatography-mass spectrometry (GC-MS) for anything that flags positive. If the death circumstances warrant it, the lab also tests for carbon monoxide, cyanide, heavy metals, or specific medications.
Toxicology and forensic pathology can take several months. The time depends on the tests and the office's workload; an amended certificate may take up to 12 weeks or longer. Ask the ME's office for an estimate for your specific case.
What Freezes While the Certificate Is Pending
Life insurance claims. Insurers typically place claims on hold when the cause or manner of death is pending while they assess whether a policy exclusion applies. A pending certificate can delay a decision or payment. Notify the insurer and ask whether it will accept a claim with the pending certificate and what documents it needs.
Bank accounts and financial assets. Banks, brokerage firms, and pension administrators may refuse to release assets or transfer titles without a finalized death certificate. Joint accounts with right of survivorship are sometimes an exception, but sole accounts or accounts with the deceased as the only signatory are typically frozen.
Probate proceedings. A pending certificate can complicate a probate filing or delay asset distribution. Ask the probate court or an estate attorney which documents it will accept and which actions must wait.
Vehicle title transfers and real property. The DMV and county recorder's office typically require a finalized certificate for title changes.

What You Can Do While Waiting
You are not completely stuck. Several things can move forward with a pending certificate:
- Social Security survivor benefits — ask SSA what it needs to start processing while the final certificate is pending
- Funeral and burial — the funeral home works from the preliminary pronouncement, not the final certificate
- Employer notification and group life insurance claim initiation — you can file the initial notification and gather required documents
- Secure the deceased's property, devices, and digital accounts — preservation does not require a death certificate
- Consult with an estate attorney — planning the probate strategy does not require a finalized certificate, and early legal advice can prevent costly mistakes
The Amended Death Certificate
Once the medical examiner completes all testing, they file an amendment with the state's vital statistics office. This corrects the "pending" designation with the final cause and manner of death.
You will need to order new certified copies of the amended certificate — the pending version does not update automatically. Contact your state or county vital records office to request the updated certificates. Some states charge per copy; order enough for every institution that has your claim on hold.
When the amended certificate arrives, immediately send certified copies to:
- Life insurance company (with a cover letter referencing your existing claim number)
- Bank(s) holding frozen accounts
- Pension or retirement plan administrators
- Probate court, if proceedings are open
- Any other institution that placed your transaction on hold
When "Pending" Becomes "Undetermined"
In some cases, even after full testing, the medical examiner cannot establish a definitive cause or classifies the manner of death as "undetermined." An undetermined manner can complicate an insurer's review, especially if it is assessing exclusions. Ask the insurer which policy provision it is evaluating and what evidence it needs.
If this happens, you may need to:
- Request a meeting with the medical examiner to understand the specific findings and why a definitive determination could not be made
- Commission a private forensic pathology review of the autopsy and toxicology results
- Engage a life insurance attorney to challenge the insurer's denial
