DIY Power of Attorney Northern Ireland: Can You Make an EPA Without a Solicitor?

The Short Answer: No Solicitor Required

Under Northern Irish law, any mentally capable adult can create and execute their own Enduring Power of Attorney without a solicitor. The Enduring Powers of Attorney (Northern Ireland) Order 1987 doesn't require professional legal involvement at any stage — not for drafting, not for signing, not for registration.

The Law Society of Northern Ireland even makes the official EPA form available directly to the public. So the idea that you "must" use a solicitor is a commercial message from law firms, not a legal requirement.

That said, there are specific situations where professional involvement genuinely earns its fee.

How to Do It Yourself

Get the prescribed form. The EPA form must be the version prescribed by the Enduring Powers of Attorney (Northern Ireland) Regulations 1989 under the 1987 Order for use in Northern Ireland. English LPA forms won't work. Welsh or Scottish forms won't work. Download or collect the correct NI form from the Law Society of Northern Ireland or a legal stationer.

Choose your attorneys. Decide who will manage your finances if you lose capacity, and whether multiple attorneys should act jointly (must agree on everything) or jointly and severally (can act independently). Add any restrictions you want — for example, requiring all attorneys to agree before selling property.

Follow the signing sequence exactly. This is the most common failure point for DIY EPAs:

1. The donor signs first, with an independent witness present
2. The witness signs, including full name, address, and occupation
3. Each attorney signs, each with their own independent witness
4. Each attorney's witness signs with full details

No attorney can witness the donor's signature. The donor can't witness an attorney's signature. Attorneys can't witness each other. One mistake in this sequence and the OCP will reject the registration years later — exactly when you need it most.

Store the original securely. The OCP requires the original signed document at registration, so it needs to survive in good condition for potentially decades. A fireproof safe, a bank safety deposit box, or a solicitor's strong room (many will store documents even if they didn't draft them, sometimes for a small annual fee).

Where DIY Goes Wrong

The form itself is simple. What catches people is the procedural detail that surrounds it:

Witnesses. Using a family member who's also a named attorney. Having an attorney witness another signature. Forgetting to record the witness's occupation. All of these can invalidate the document.

Capacity questions. If the donor's capacity is borderline — early-stage dementia, fluctuating lucidity — and you skip the medical assessment step, a relative could challenge the EPA at registration. A solicitor would arrange a contemporaneous GP certificate; doing it yourself, you should request one directly from the donor's GP.

The EP1 relative notification order. When it's time to register (because the donor is losing capacity), the attorney must serve EP1 notices following a rigid priority list of ten classes of relative. Missing a class or skipping a difficult family member gives the OCP grounds to reject the application.

When a Solicitor Is Worth It

• Borderline capacity — the solicitor documents capacity assessment at the time of signing, which protects against challenges
• Complex family dynamics — estranged relatives, second marriages, potential for disputes
• Substantial property — if the EPA covers commercial property, business interests, or agricultural land, tailored restrictions matter
• Cross-border assets — if the donor owns property in the Republic of Ireland or Great Britain, the EPA may need to work alongside instruments in those jurisdictions

For a straightforward single-dwelling, pension-and-savings situation with cooperative family members, DIY is perfectly reasonable. You'll save £200–£500 in solicitor fees and spend only the £189 registration fee when the time comes.
