When Does an EPA Start in Northern Ireland?
An EPA Is Active From the Moment It's Signed
This surprises most people. A Northern Ireland Enduring Power of Attorney does not sit dormant until the donor loses capacity. Unless the donor has explicitly included a restriction saying the EPA can only be used upon incapacity, the attorney's authority begins immediately after execution — as soon as the donor and attorney have both signed in the presence of their respective witnesses.
While the donor retains capacity, the EPA works like a General Power of Attorney. The attorney can manage the donor's bank accounts, pay bills, handle investments, and deal with financial institutions — all with the donor's ongoing consent and under their supervision. The donor can still make their own decisions and override the attorney's actions. Registration with the Office of Care and Protection (OCP) is not required during this phase.
Why Would You Use an EPA Before Incapacity?
Practical convenience. An older person might want a trusted family member to handle their banking while they're physically frail but mentally sharp — visiting a branch is difficult, online banking is confusing, or they simply prefer someone else to manage routine finances. The EPA provides legal authority to do this without needing to add the family member as a joint account holder.
It's also useful for planned absences. If the donor is going into hospital for scheduled surgery, the attorney can manage their financial affairs during recovery without any gaps.
The key point: the donor retains full control during this phase. They can revoke the EPA, amend it, appoint a new attorney, or take back direct management of their affairs at any time. The attorney acts with the donor, not instead of them.
The Registration Trigger — "Reason to Believe"
Everything changes when the donor's mental capacity comes into question. As soon as the attorney has reason to believe the donor is becoming mentally incapable, a legal obligation kicks in: they must apply to register the EPA with the OCP.
"Reason to believe" is deliberately set at a low threshold. It doesn't require a formal dementia diagnosis. Repeated confusion about bills, difficulty remembering the purpose of bank accounts, disorientation about time and place, or a GP expressing concern about cognitive decline — any of these can trigger the duty.
Continuing to use an unregistered EPA after the donor has lost capacity is a statutory breach. Any major financial transaction carried out under an unregistered EPA during incapacity is legally void and can be unwound by the court.

What Happens During Registration
Registration isn't instant. Before filing Form EP2 with the OCP, the attorney must serve Form EP1 notices — personally to the donor and by first-class post to normally at least three qualifying relatives in statutory priority order; if fewer than three living relatives are available, explain that on the application. Then the OCP imposes a 35-day hold from the date the last notice was served.
During that 35-day window, the attorney's authority is restricted to essentials only:
- Allowed: utility bills, nursing home fees, groceries, household maintenance, insurance premiums
- Not allowed: selling property, changing investments, making gifts, entering new contracts, repaying debts other than household essentials
This restriction protects the donor while relatives have the opportunity to raise objections. If a family member believes the attorney is unsuitable or the EPA was improperly executed, they have 28 days to lodge a formal objection.
After Registration — Full Authority
Once the OCP stamps the EPA as registered (assuming no valid objections), the attorney holds full legal authority over the donor's property and financial affairs. The scope doesn't expand — it was always defined by the EPA document itself — but the restrictions that applied during the 35-day hold are lifted.
From this point, the attorney can sell property, manage investments, access all accounts, and make financial decisions on the donor's behalf. Every action must still serve the donor's best interests, and the OCP retains the authority to investigate if a complaint is raised.
Can You Delay Registration?
Technically, the 1987 Order doesn't set a fixed number of days for filing. But the statute says registration must happen when the attorney has reason to believe the donor is losing capacity, so the process should be started promptly. Deliberate delay is a breach of the attorney's statutory duty.
Some attorneys delay because they want to avoid the £189 registration fee, the 35-day restriction period, or the hassle of serving EP1 notices. This is risky. If the attorney makes a significant financial decision using an unregistered EPA after the donor has lost capacity, and the transaction is later challenged, it will be treated as void and can be unwound by the court. The attorney may be required to account for losses.
The Bottom Line: Active Early, Restricted at Incapacity, Full After Registration
The lifecycle is clearer than most people realise:
- Signed → immediate authority (with donor's ongoing consent, no registration needed)
- Donor losing capacity → mandatory registration trigger (apply promptly)
- 35-day hold → restricted to essentials only
- Registered → full financial authority (subject to best-interests duty)
Understanding this timeline prevents two common mistakes: assuming the EPA is useless until incapacity (it isn't — use it early for convenience) and assuming you can keep using it indefinitely without registering once cognitive decline begins (you can't — registration is mandatory).
