How to Register an EPA in Northern Ireland: Process and Timeline

When Registration Becomes Mandatory

An Enduring Power of Attorney works immediately after signing unless the donor included a restriction saying otherwise — while the donor has capacity, there's no requirement to register it with anyone. But the moment the attorneys have reason to believe the donor is losing or has lost mental capacity, they are legally obliged to register the EPA with the Office of Care and Protection (OCP) in Belfast.

"Reason to believe" is a low threshold. It doesn't require a formal dementia diagnosis. If the donor is struggling with financial decisions, forgetting to pay bills, or showing signs of confusion about their affairs, that's enough to trigger the registration duty. Continuing to manage finances under an unregistered EPA after the donor has lost capacity breaches the registration duty and puts transactions at risk.

Step 1: Serve EP1 Notices

Before you can file the registration application, you must serve Form EP1 (Notice of Intention to Register) on specific people:

The donor. EP1 must be delivered personally — hand-delivered, not posted. If personal service would cause the donor severe psychiatric distress, you can apply to the court using Form EP3 to dispense with this requirement, but that's a separate application with its own £326 fee.

At least three qualifying relatives. EP1 notices go by first-class post to relatives following a strict statutory priority order under Schedule 1 of the 1987 Order:

  1. Spouse or civil partner
  2. Children
  3. Parents
  4. Brothers and sisters (whole or half blood)
  5. Widow, widower, or surviving civil partner of a child
  6. Grandchildren
  7. Children of brothers and sisters of the whole blood
  8. Children of brothers and sisters of the half blood
  9. Uncles and aunts (whole blood)
  10. Children of uncles and aunts of the whole blood

The critical rule: if you must notify anyone in a class, you must notify everyone in that class. If the donor has no spouse and no children but has five siblings, all five get an EP1 notice.

Non-applying co-attorneys. If the EPA names joint and several attorneys and not all are joining the registration, the applying attorneys must serve EP1 on the others.

Record the exact date you serve each EP1. You'll need these dates for the EP2 application.

Step 2: File EP2 with the OCP

Once the last EP1 notice has been served, prepare the registration package:

  • Form EP2 (Application to Register an EPA), with dates of all EP1 notices listed
  • The original signed EPA document (not a copy)
  • £189 court fee (payable to NICTS; waived if the donor receives means-tested benefits — submit Form ER1 for exemption)

Send this by recorded delivery or hand-deliver it to the Office of Care and Protection at the Royal Courts of Justice, Chichester Street, Belfast BT1 3JF.

Step 3: The 35-Day Hold

Once the OCP receives your application, the papers are held for 35 days from the date the last EP1 notice was served. A notified relative must lodge a formal objection within four weeks (28 days) of receiving their EP1 notice.

Grounds for objection include fraud, undue pressure on the donor, the attorney's unsuitability, or a claim that the donor never had capacity when signing the EPA.

If no objections are filed, the OCP stamps the original EPA as registered and returns it to the attorneys.

What You Can and Cannot Do During the Wait

During the 35-day hold, the attorneys' powers are restricted. They can pay for:

  • Essential living expenses (food, utilities, care home fees)
  • Mortgage or rent payments
  • Insurance premiums already in force

They cannot:

  • Sell property
  • Reallocate investments
  • Make gifts
  • Enter new financial commitments

Total Timeline

From serving the first EP1 notice to receiving the registered EPA back from the court, expect five to eight weeks. The 35-day hold is the bulk of that; the OCP's processing time for uncontested applications is typically one to two weeks on top.

If an objection is filed, the timeline extends significantly — the Master of the High Court must schedule a hearing, and resolution can take months.
