How to Set Up Power of Attorney in Northern Ireland

Get the Right Form First

Northern Ireland doesn't use the Lasting Power of Attorney that England and Wales switched to in 2007. Here, you need the Enduring Power of Attorney (EPA) form prescribed by the Enduring Powers of Attorney (Northern Ireland) Regulations 1989 under the 1987 Order. Using an English LPA form — even if you downloaded it from a legitimate UK legal site — will be rejected outright by the Office of Care and Protection (OCP) in Belfast.

The official EPA form is available from the Law Society of Northern Ireland or from legal stationers. It's free to obtain, though some commercial sites will charge you for the same document with added guidance. What matters is that you use the unmodified prescribed form — no crossing out, no white-out corrections, no initialled amendments.

Choose Your Attorneys Carefully

You need to appoint at least one attorney, but you can appoint more. The critical decision is how multiple attorneys should operate:

  • Jointly — every attorney must agree on every decision, sign every document together. If one dies, becomes bankrupt, or loses capacity, the entire EPA collapses unless the document provides for replacement attorneys.
  • Jointly and severally — attorneys can act together or independently. If one drops out, the others continue seamlessly.

For most families, jointly and severally is the safer choice. It avoids the practical nightmare of needing all attorneys physically present for routine bank transactions.

You can also add restrictions — for example, allowing day-to-day account management but requiring all attorneys to agree before selling property.

The Signing Sequence That Cannot Be Bent

This is where most DIY EPAs go wrong. The Enduring Powers of Attorney (Northern Ireland) Regulations 1989 demand a strict chronological sequence, and the OCP will reject applications where signatures are out of order:

  1. The donor signs first, in front of an independent witness
  2. The witness signs, printing their full name, address, and occupation
  3. Each attorney signs next, each in front of their own independent witness
  4. Each attorney's witness signs with full details

The critical restrictions on witnesses: an attorney cannot witness the donor's signature. The donor cannot witness an attorney's signature. One attorney cannot witness another attorney's signing. Every witness must be independent.

What the EPA Actually Covers (and Doesn't)

An EPA in Northern Ireland grants authority over property and financial affairs only. There is no mechanism under current NI law to grant a power of attorney over healthcare or personal welfare decisions. The Mental Capacity Act (Northern Ireland) 2016 was supposed to introduce that, but the relevant provisions remain uncommenced.

This means your EPA attorney can manage bank accounts, pay bills, sell property, and handle investments — but they cannot consent to or refuse medical treatment on your behalf. For healthcare planning, you'd need a separate Advance Decision to Refuse Treatment (ADRT) or an Advance Statement, neither of which is made through the EPA process.

When to Register and What It Costs

The EPA works immediately after signing unless its terms restrict when it can be used — no registration needed while the donor has capacity. But as soon as the attorneys have reason to believe the donor is losing or has lost mental capacity, they are legally obliged to register the EPA with the OCP in Belfast.

Registration requires:

  • Serving EP1 notices to the donor (personally) and at least three relatives (by first-class post), following a strict statutory priority order
  • Filing Form EP2 with the OCP, along with the original EPA and the £189 court fee
  • Waiting through a mandatory 35-day hold after the last EP1 notice

During that 35-day window, attorneys can only spend the donor's money on essential maintenance — utility bills, care home fees, groceries. No property sales, no investment changes.

The full process from filing to receiving the stamped, registered EPA typically takes five to eight weeks.

What Comes Next

Once the EPA is registered, the attorney holds full legal authority over the donor's finances. The OCP doesn't monitor day-to-day transactions, but any concerned relative or healthcare trust can trigger a court-ordered financial audit.
