Why This Conversation Can't Wait

Most families don't think about power of attorney until something goes wrong — a fall, a hospital admission, a moment when Mum can't remember the PIN she's used for twenty years. By then, the window may be closing.

An Enduring Power of Attorney in Northern Ireland must be created while the donor has mental capacity. Once that capacity is gone, it's gone permanently. There's no backdating, no emergency court order that creates an EPA after the fact. The alternative — a High Court controllership through the Office of Care and Protection in Belfast — costs over £2,000 in the first year and takes about six months to arrange, during which nobody can legally manage your parent's finances.

Starting the Conversation

This is the hardest part for most families. No parent wants to hear "I need to take over your money." The framing matters:

  • Make it mutual. If you and your parent both create EPAs, it's a family planning exercise rather than a one-directional power grab.
  • Focus on the practical. "If you were in hospital for two months, who pays the electricity?" is easier to engage with than abstract discussions about cognitive decline.
  • Name the alternative. Explaining that without an EPA, a judge in Belfast would choose who manages their money — and that person would need a specific court order to incur any expense over £500 — tends to concentrate minds.

The Process for Your Parent

Step 1 — Get the form. The prescribed Northern Ireland EPA form from the Law Society of NI. Not an English LPA form — those are invalid here.

Step 2 — Decide on scope. Your parent chooses what powers to grant and any restrictions. Common restrictions include requiring all attorneys to agree before selling property, or limiting authority to specific bank accounts.

Step 3 — Choose attorneys. Your parent names who they want — one child, multiple children, a combination of family and a trusted friend. If naming multiple attorneys, "jointly and severally" is usually the practical choice: it means any one attorney can act independently, so routine banking doesn't require everyone to be present.

Step 4 — Sign correctly. Your parent signs first with an independent witness, then each attorney signs with their own independent witness. No attorney can witness the parent's signature, and the parent can't witness any attorney's. This sequence is legally mandatory and commonly botched.

Step 5 — Store the original safely. The EPA works immediately unless its terms restrict when it can be used, but it doesn't need to be registered until your parent starts losing capacity. The original document needs to survive for years or decades — a fireproof safe, a solicitor's strongroom, or a bank safety deposit box.

If Capacity Is Already Declining

Don't assume it's too late. Dementia is a spectrum, and capacity is assessed at the time of signing, not by diagnosis. If your parent can understand what an EPA is, what powers they're granting, and who they're choosing as attorney, they can still sign a valid EPA.

Arrange a GP assessment on the same day or week as the signing. The doctor's contemporaneous certificate confirming capacity protects the document if another family member challenges it during registration.

Schedule the signing for your parent's best time of day — morning is often clearest for people with cognitive decline. Keep the environment calm, familiar, and free from pressure.

What the EPA Won't Cover

Northern Ireland's EPA covers finances and property only. It does not grant authority over healthcare decisions — that gap in NI law hasn't been filled yet, despite the Mental Capacity Act 2016 being on the books. For healthcare planning, your parent would need a separate Advance Decision to Refuse Treatment or Advance Statement.
