The Amphur Issues the Death Certificate — Not the Hospital, Not the Embassy

When a British national dies in Thailand, the hospital issues a clinical confirmation of death. This document triggers the process, but it is not a legal death certificate. UK probate courts, airlines, and insurers will reject it as proof of death.

The official Thai death certificate comes from the local district office — the Amphur in provinces, or the Khet in Bangkok — where the death occurred. Thai law requires registration within 24 hours of the death or discovery.

If the family is in the UK, they cannot walk into the Amphur themselves. They need a representative on the ground in Thailand with a valid Power of Attorney.

How to Appoint a Representative from the UK

A Power of Attorney (POA) executed during the deceased's lifetime terminates automatically at death under Section 1620 of the Thai Civil and Commercial Code. The family must execute a new post-death POA naming a local representative — a licensed Thai lawyer, a repatriation specialist, or a trusted contact.

Before February 28, 2027, the full legalisation chain applies:

1. Draft the POA naming the representative and specifying their authority (death registration, body release, bank account access, etc.)
2. Sign before a UK notary public or solicitor
3. Obtain an FCDO apostille from the UK Foreign, Commonwealth & Development Office
4. Submit to the Royal Thai Embassy in London (29-30 Queen's Gate, SW7 5JB) for consular attestation
5. Have the POA translated into Thai by a certified translator in Bangkok
6. Legalise the translation at the MFA Legalisation Division in Bangkok

This chain takes three to four weeks. The Royal Thai Embassy in London often has booking delays of one to two weeks for legalisation appointments.

After February 28, 2027, the process simplifies. Thailand's accession to the Hague Apostille Convention means a UK FCDO apostille on the POA is sufficient — no Royal Thai Embassy attestation needed. The Thai MFA will accept the apostilled document directly.

What the Representative Takes to the Amphur

The representative presents:

• The deceased's original passport
• The hospital medical confirmation of death (or the police report, for non-hospital deaths)
• The legalised Power of Attorney
• The British Embassy's next-of-kin notification letter

The registrar verifies these and issues a single original Thai-language death certificate. This is the critical moment: request five to ten certified copies at THB 10 each. The UK estate will need copies for probate, banks, pension funds, and insurers. Obtaining duplicates later means returning to the Amphur with a judicial petition and physical assistance in Thailand from a Thai lawyer.

Translation and Legalisation of the Certificate

The Thai death certificate must then be translated into English by a certified translator (THB 800 to THB 1,050 per page, one to three working days). The translation must match the passport spelling of the deceased's name exactly — a single character discrepancy can cause UK probate to reject the document.

The translated certificate is submitted to the MFA Legalisation Division (appointment required, two- to seven-day processing). Before February 2027, the legalised translation then goes to the Royal Thai Embassy in London for final consular stamps. After February 2027, a single MFA apostille replaces this step.
