Infonavit Debt Cancellation After Death: The Built-In Life Insurance
If your family member had an active Infonavit home loan and just died in the United States, the family does not inherit the debt. Active Infonavit loans include a built-in life insurance policy called the Autoseguro por Defunción that can cancel the remaining mortgage balance after the death is reported and the claim is approved.
The family keeps the home. The debt disappears. But only if you file the right paperwork.
How the Autoseguro Works
Every active Infonavit loan includes life insurance coverage at no extra cost to the borrower. When the borrower dies, this insurance can pay off the remaining loan balance once the required claim is approved. The surviving family members — typically the spouse or children — can then receive the property free and clear of the mortgage.
This isn't optional or something the borrower had to sign up for. It's built into the loan structure. If the loan was active (payments were current or in a recognized payment arrangement) at the time of death, the insurance applies.
What You Need to File
For a death that occurred in the United States, the documentation requirements are the same as for any cross-border Mexican administrative claim — with one additional step:
- Certified US death certificate — apostilled by the Secretary of State in the state where the death occurred
- Certified Spanish translation — done by a perito traductor certified by a Mexican TSJ
- Mexican death certificate or registration — either a consular death certificate from the Mexican consulate in the US, or a foreign death inscription at a Registro Civil in Mexico
- The deceased's official Mexican ID — INE, passport copy, or CURP
- Infonavit loan reference number — the borrower's credit number (número de crédito)
- Claimant's ID and proof of relationship — marriage certificate, birth certificate, or designated beneficiary documentation
The Claim Process Step by Step
Get a case number (número de caso): Contact Infonavit through their portal (portalmx.infonavit.org.mx) or their customer service line. Report the death and request a case number. This initiates the cancellation process.
Submit the documentation: Bring or send the complete document package to the nearest Infonavit service center (CESI). If the family is in the US, they can authorize a representative in Mexico through a Power of Attorney executed at a Mexican consulate.
Infonavit reviews and processes: The agency verifies the death, confirms the loan was active, and triggers the Autoseguro coverage. Processing typically takes 30 to 60 days once documentation is complete.
Debt is cancelled: The remaining balance is written off. Infonavit issues a release letter confirming the loan is fully satisfied.
Property transfer: The property title can then be transferred to the surviving heir through the normal estate succession process (either testamentary if a will exists, or intestate through a Mexican notary or court).

Common Problems and Delays
Name mismatch: The name on the US death certificate must match Infonavit's records, which use the borrower's full dual-surname legal name. If the US certificate uses an anglicized or single-surname version, you'll need the AKA clause or amendment before Infonavit will process the claim.
Lapsed loan status: If the borrower had fallen behind on payments and the loan was in default at the time of death, the Autoseguro coverage may be disputed. Contact Infonavit to clarify the loan's status before investing in the document authentication process.
Missing Mexican death registration: Infonavit requires the death to be registered in the Mexican system. A US death certificate alone — even with apostille and translation — may not be sufficient. The consular death certificate or Registro Civil inscription is the document Infonavit actually needs.
Confirm Payment Instructions with Infonavit
Once the death has been reported to Infonavit, ask the agency how to handle payments while the Autoseguro cancellation is processed. Do not assume that payments made after the date of death will be refundable.
Do not stop payments until you have confirmed with Infonavit that the death has been registered in their system and the cancellation process is active. Stopping payments before that confirmation can trigger default proceedings.
