Maine's Uniform Probate Code (Title 18-C of the Maine Revised Statutes) offers three paths for handling a decedent's estate, and the one you'll use depends on the estate's size, whether there's a valid will, and whether anyone objects. Understanding which track applies now — during estate planning — lets you structure things so your family gets the simplest path possible.
The Three Tracks
Small Estate Affidavit (No Court)
If the decedent owned no real property in Maine and the gross probate estate is $52,500 or less (2026 inflation-adjusted limit), heirs can skip probate entirely. They execute a small estate affidavit at least 30 days after death and present it directly to banks, brokerages, and the Bureau of Motor Vehicles to collect assets. No court filing, no fees, no waiting.
The limit rises annually for inflation — it was $49,700 in 2024 and $51,100 in 2025.
Informal Probate (Register of Probate)
The standard track for uncontested estates. The personal representative files an application with the county Register of Probate — a court clerk who handles the paperwork administratively. No hearings, no judge. This is where the vast majority of Maine estates end up.
Requirements for informal probate:
- An original will that appears valid on its face, or clear intestate succession if no will
- No disputes about who should serve as personal representative
- No challenges to the will's validity
- No complex creditor disputes
Timeline: 9-12 months from appointment to closing, driven by the mandatory 4-month creditor claim window and the time needed to file tax returns and release the estate tax lien.
Formal Probate (Probate Judge)
When something is contested — the will's validity, who should serve as personal representative, creditor claims, distribution disputes — the estate moves to formal probate. This requires:
- A petition filed with the Probate Court
- Formal notice to all interested parties
- Hearings before a Probate Judge
- Significantly higher legal costs (attorney involvement is essentially mandatory)
Formal probate can take 18 months to several years for complex disputes.
Filing Fees by Estate Value
Probate court fees scale progressively. Here's what the personal representative pays at filing:

Planning to Stay on the Simple Track
The goal of estate planning is to keep your family on the small estate affidavit or informal probate track. That means:
Structure assets to bypass probate. Transfer on Death Deeds for real estate, POD/TOD designations on accounts, and named beneficiaries on retirement and insurance policies all remove assets from the probate estate. If your probate estate drops below $52,500 with no real estate, your family avoids court entirely.
Leave a clear, unambiguous will. Vague language, conditional bequests without clear triggers, or outdated beneficiary references create the disputes that force formal probate.
Name a personal representative everyone trusts. In blended families especially, pick someone all sides view as fair. A contested appointment petition instantly escalates the estate to formal probate.
Coordinate everything. A will that says one thing while beneficiary designations say another creates conflict — and conflict means formal probate.
