Iowa Power of Attorney Requirements: What Makes It Legally Valid
A power of attorney that fails Iowa's execution requirements is worthless — banks will reject it, courts will ignore it, and your family will be forced into expensive guardianship proceedings. Here is exactly what Iowa Code Chapter 633B demands.
Five Mandatory Requirements
1. The Principal Must Have Legal Capacity
The person granting authority (the principal) must understand what they are signing, who their agent will be, and what powers they are granting. A diagnosis of early-stage dementia does not automatically disqualify someone — capacity is assessed at the moment of signing, not based on a general medical condition.
2. The Document Must Be in Writing
Oral powers of attorney are not valid in Iowa. The document must be written, identify a specific agent, and describe the scope of authority being granted.
3. The Principal Must Sign (or Direct Someone to Sign)
The principal must personally sign the document, or another adult may sign in the principal's conscious presence and at their explicit direction. This accommodation exists for principals who are physically unable to sign but mentally competent.
4. A Notary Must Acknowledge the Signature
For financial POAs under Chapter 633B, notarization is mandatory — not optional. The signature must be formally acknowledged before a notary public. An acknowledged signature carries a legal presumption of genuineness under Iowa law.
The designated agent is prohibited from notarizing the principal's signature to prevent conflicts of interest.
5. The Agent Must Be Identified and Competent
Iowa law requires naming a specific individual as agent. The agent must be a competent adult. You can name co-agents (who must act by majority rule unless the document says otherwise) and successor agents who step in if the primary agent cannot serve.
Durable by Default
Under Iowa Code Section 633B.104, every Iowa power of attorney is automatically durable — meaning it survives the principal's subsequent incapacity. You do not need to include special "durable" language. The POA remains effective unless the document explicitly states it terminates upon incapacity.
This is the opposite of some other states where you must add specific durability language. In Iowa, the default protects you.
Healthcare POA Has Different Rules
The healthcare POA under Chapter 144B has a separate execution pathway:
- Option A: Notarize the signature (same as financial POA)
- Option B: Sign before two qualified witnesses — both must be 18+, at least one must be unrelated to the principal by blood, marriage, or adoption within the third degree
Additionally, the healthcare POA is strictly springing — it only activates when an attending physician certifies that the principal lacks decision-making capacity. Unlike the financial POA, there is no "effective immediately" option.

What Happens If You Skip a Step
Banks and financial institutions are legally required to accept a validly executed statutory POA under Iowa Code Section 633B.120. But they are equally within their rights to reject documents that were not properly notarized, that lack required initialing for hot powers, or that were notarized by the agent themselves.
The difference between a valid and invalid document often comes down to execution details — which notary you used, whether the hot-powers section was initialed, whether the real estate POA was recorded with the county recorder.
