Medical Tourism Death in India: Hospital Bills, Visa Status, and What Families Face

The Bill Clearance Problem

When a British citizen dies during medical treatment in India, private hospitals routinely withhold the cause-of-death certificate until the medical bill is fully settled. This isn't a legal requirement — it's hospital policy. But without the cause-of-death certificate, the family cannot register the death with the municipal registrar, which means no death certificate, no apostille, no repatriation, and no UK probate.

The bill can be substantial. India's private hospital costs are lower than UK prices overall, but complex surgeries, ICU stays, and emergency interventions can run into lakhs of rupees. If the deceased was uninsured or if the insurance company disputes the claim, the family is in a standoff with a hospital that holds both the paperwork and the body.

How to Break the Deadlock

Several approaches work:

Pay the bill. The most direct route. If the family has funds or the deceased had health insurance that covers the treatment, settling the bill releases the paperwork immediately. Keep detailed receipts — UK health insurers and travel insurers will need them for claims.

Negotiate with the hospital administrator. Most private hospitals have a bereavement or patient liaison officer. In some cases, particularly when the bill is disputed (unnecessary procedures, charges for unused services), the hospital will release the cause-of-death certificate and hold the financial dispute separately.

Involve the British High Commission. Consular staff cannot pay the bill or compel a private hospital to release documentation. You can ask what communication or liaison help is available.

Legal action. If the dispute cannot be resolved, ask an Indian lawyer whether urgent court relief is available in your circumstances.

The Visa Complication

Medical tourism visas have specific terms. If the deceased was on a medical visa and the hospital failed to report their ongoing treatment to the FRRO, there may be a registration compliance issue that complicates departure clearance for the remains.

If the visa expired during treatment (extended hospital stays aren't uncommon), the family faces the additional burden of obtaining an exit permit through the e-FRRO portal — a process that can take up to 90 days and may incur overstay fines.

The hospital is supposed to coordinate visa documentation for patients on medical visas, but in practice the family or their representative often has to chase this independently.

Death Certificate from a Private Hospital

Private hospitals may issue the medical cause-of-death certificate used for municipal registration. Confirm the form and the local registrar's requirements. Also verify three things:

1. The name matches the deceased's passport exactly
2. The cause of death is clearly stated (some hospitals use vague language that the municipal registrar may query)
3. The certificate carries the attending physician's registration number and hospital stamp

If the family cannot immediately settle a private hospital bill, ask the municipal registrar or an Indian lawyer what alternative documentation or release process applies. Transfer to a government hospital mortuary is not a guaranteed workaround.

What Comes After

Once the bill is resolved and the cause-of-death certificate is in hand, the process follows the standard path: municipal death registration within 21 days, MEA apostille, and either repatriation or local cremation.
