Two Separate Documents, Two Separate Purposes
England's LPA system splits decision-making authority into two entirely distinct legal instruments. A Property and Financial Affairs LPA covers bank accounts, bill payments, property sales, pension drawdowns, tax filings, and investment management. A Health and Welfare LPA covers medical treatment decisions, care home placements, daily welfare choices, and — if the donor opts in — decisions about life-sustaining treatment.
You cannot combine them. The OPG processes each as a separate application with a separate £92 registration fee (£184 total for both), separate signing ceremonies, and separate registration timelines.
When Each One Activates
This is where the two types diverge sharply. A Property and Financial Affairs LPA can be used immediately after registration, while the donor still has full mental capacity — the donor chooses in Section 5 whether the attorney can act straight away or only after they lose capacity. Most donors choose immediate activation because it allows the attorney to help with routine tasks like paying bills while the donor is in hospital or travelling.
A Health and Welfare LPA works on a completely different trigger. It can only be used after the donor has lost the mental capacity to make the specific decision in question. If the donor can still make their own healthcare choices — even with support — the attorney has no authority to override them. This is a hard legal boundary, not a soft guideline.
Do You Need Both?
In practical terms, yes. Having only a financial LPA leaves no one authorised to make medical decisions if you lose capacity. The NHS will follow clinical protocols, but there will be no one with legal standing to challenge a treatment plan, choose a care home, or request a second opinion on your behalf.
Having only a health LPA means no one can access your bank accounts to pay for that care. Your mortgage, council tax, and utility bills go unpaid. Eventually your family may need to apply to the Court of Protection for a financial deputyship — a process that takes 6 to 9 months and costs upwards of £432 in application fees alone, plus the standard £320 annually in OPG supervision charges (or £35 under minimal supervision for qualifying estates).

The Signing Process Is Identical for Both
Both types follow the same strict chronological signing sequence mandated by the Mental Capacity Act 2005. The donor signs first (Section 9), witnessed by an independent adult who is not a named attorney or replacement attorney. The certificate provider signs next (Section 10), on the same day or later. Each attorney signs last (Section 11), witnessed by an adult who is not the donor. Any deviation — even a single day out of sequence — results in the OPG rejecting the application after an 8 to 10-week wait.
You can submit both LPAs to the OPG at the same time in one envelope, and the fee remission form LPA120 covers both if you qualify (gross annual income below £12,000, or receiving qualifying means-tested benefits).
Key Differences at a Glance
The financial LPA can be activated while the donor has capacity. The health LPA cannot. The financial LPA terminates if the sole attorney goes bankrupt. The health LPA does not — bankruptcy is irrelevant to healthcare decisions. The health LPA can include authority over life-sustaining treatment, but only if the donor explicitly opts in at Section 5. The financial LPA has no equivalent opt-in — it covers all financial matters by default, subject to any restrictions the donor writes into Section 7.
