What a Health and Welfare LPA Actually Does
A Health and Welfare Lasting Power of Attorney gives someone you trust — your attorney — the legal authority to make medical and care decisions on your behalf if you lose mental capacity. Under the Mental Capacity Act 2005, this is the only way to formally appoint a healthcare proxy in England.
Your attorney can make decisions about daily care, medical treatment, where you live, and what you eat. But there is one critical restriction: an attorney cannot refuse life-sustaining treatment on your behalf unless you explicitly grant that authority in the LPA document itself. Without that specific clause, clinicians make those decisions under the "best interests" framework.
The Health and Welfare LPA is separate from the Property and Financial Affairs LPA. They are two distinct legal instruments, filed and registered independently. You need both if you want full coverage.
Registration Is Not Optional
Unlike many international jurisdictions where a signed healthcare proxy takes effect immediately, an English Health and Welfare LPA has zero legal validity until the Office of the Public Guardian (OPG) registers it. An unregistered LPA is legally worthless — even if your GP confirms you have lost capacity.
Registration currently takes 8 to 12 weeks for online applications and 10 to 16 weeks for paper forms. The fee is £92 per document, so registering both Health and Welfare and Property and Financial Affairs LPAs costs £184.
If you are on a low income, you may qualify for a fee reduction. Universal Credit claimants are assessed under a 50% remission test — your gross annual income must be below £12,000. Submit Form LPA120 with 12 months of consecutive UC statements at the same time as the registration. The OPG does not accept retrospective fee applications.
The Signing Sequence That Trips People Up
The OPG rejects roughly 15% of DIY applications because of signing errors. The chronological sequence is strict and non-negotiable:
- The donor signs Section 9 first
- The certificate provider signs Section 10 on the same day or later
- Each attorney and replacement attorney signs Section 11 after the certificate provider
If an attorney signs before the certificate provider dates their section, the entire LPA is invalid. You will need to re-execute the documents; if you reapply within three months using the returned case number, the repeat application fee is £46, otherwise the standard fee applies.

How It Interacts with an ADRT
The relationship between a Health and Welfare LPA and an Advance Decision to Refuse Treatment follows a strict chronological priority rule.
If you register an LPA that grants authority over life-sustaining treatment after you have made an ADRT, the LPA overrides the ADRT. Your attorney gains the right to override the specific treatment refusals in your earlier document.
If you make an ADRT after registering the LPA, the ADRT takes precedence. Your attorney cannot consent to any treatment that your subsequent ADRT explicitly refuses.
Getting this sequencing wrong can quietly undo your planning. If you hold both documents, check when the ADRT was made, when the LPA was registered, and whether the interaction produces the outcome you actually intend.
What Happens Without One
Without a registered Health and Welfare LPA, no family member has automatic legal authority over your medical care — regardless of what most people assume about "next of kin." Doctors make treatment decisions based on their clinical assessment of your best interests, and your family's input is advisory only.
If your family needs formal authority after capacity is lost, they may need to apply to the Court of Protection for a deputyship order or a one-off decision, depending on the issue. That process typically costs over £2,000 in court fees and legal costs, and it can take close to a year.
